Law 2nd Amendment Doesn't Exist in Hawaii Because of "Aloha Spirit"

So, there was a case in Hawaii about open carrying a handgun (since Hawaii refuses to issue Concealed Carry Permits to mere plebs) . The lower appellate court ordered a dismissal of charges and the state appealed. The state supreme court issued a ruling that says the Heller and Bruen decisions the US Supreme Court don't actually apply because, and I wish I was kidding here, the "Aloha Spirit" and then they quoted the TV show The Wire character Slim Charles who said "the thing about the old days, they the old days." Seriously.

The entire decision reads like something Ketanji Brown would come up with. It's amazing. You don't even need to be a lawyer to read this one, but being a moron helps.

Point taken, but, there's a difference between citing it and using it to try and invalidate a SCOTUS decision.
More importantly, the US justice system (unlike say, the South African, Canadian, or even the Scottish and English Justice systems) does not try and pretend that its not based around the common law of the Kingdom of England, of which the Magna Carta is a foundational document. You run into this alot in property law, especially on the East Coast of the United States, as there are still properties out there deeded by the Monarchy of England (not even Great Britain, literally "England"), the most famous being the "College of William and Mary" whose land and title were deeded by King William III.

The US Courts, being common law courts that originated from the Kingdom of England, have to give judicial notice to prior cases that precede the United States, if those cases are relevant to the issue and have not been reversed in more modern situations.
 
Yep. Before Kamehameha, it was the prerogative of the ruling caste to kill their "serfs" for whatever reason, to stay in practice for war, or because you were pissed off for an unrelated reason. After this happened, he realized it was kind of fucked up and made a law prohibiting the practice.
Look man, it was a pre-Christian neolithic society on the Malthusian edge with constant war and wholesale bloodshed. Life was really fucking cheap and infanticide rife.
I don't understand why folks are surprised by the brutality of Hawaii before colonization. It's really no different than Native American history, lots of wars, politics and what not. Now, if tourism didn't exist along with the military presence the islands would be classed as uninhabitable with how isolated it is. It is probably why a lot of construction projects take forever, there is not enough industry on the islands and everything has to be shipped in from either main lands.

I guess that isn't completely true, I don't know what the tech sector is like in Hawaii now a day. I think that would be the only real exportable route of income I could think of. Still, I do miss free diving alongside Kamohoalii, Nanaue being one of my favorite folk stories.
