That is likely the only charge that might stick; and IF the judge takes an extreme risk to be ripped a new one by an appellant court and designates "NLM" a "terrorist organization" arguing that the chat group only exists as an organized effort to intimidate the public as coerce political actors for specific political goals, which until now no Dutch judge has done, and is a long shot for a nihilist "organization", he could face between 12 years and up to life long imprisonment. If the judge plays it save, he gets maximum 4 years probation.

Considering that the "journalists" had to play retards and "confront" him, the judge very likely plays it save. another sadist is going to walk free because the left had to larp as moral police.

This is not America, this is another court of law; justice and application is wildly different depending on court system, Anglo applications in non Anglo countries are a weak argumentative; unless you and I want to study Dutch law, we can argue validity of the defenses and prosecutions roles in the matter. Anything else is projection of Anglocentrics, of which you rely on as your sole means of justice scope.

Regardless, in Denmark, and other surrounding European states, NLM is indeed, a registered terrorist organization, same level as Al Quadea, ISIL, etc. This is how very serious this new field of NVE, in regards to groups such as 764, 09A, and NLM is being taken in. It does not matter what the original intent was, it has evolved to become as such, under his watch and encouragement.

Correct. Its a jurisdiction that is based on Roman Law, or more specific Roman-Dutch law, which combines Roman law (continental law) principles with custom Dutch traditions, contrary to the common law system practiced in the USA and UK.

Please provide sources. That was what I wasn't sure about, and trying to find sources that indeed would show that 09A/NLM/MKY/764.... are considered terrorist organization in EU member states or on the supranational level only lead to sources stating that they are NOT being considered Foreign or Domestic Terrorist Organizations and that until date every member of these groups in the EU being trialed, has been trialed according to the respective penal laws as individuals, not organizations.

So I went by the Dutch legislation on what a terrorist organization would be and that is Art. 140a WvSr (Penal law book) in combination with Art. 83a WvSr, which states that a terrorist organization is an organization that implicitly "[...]are intended to seriously intimidate the population, unlawfully compel a government/international organization to act or refrain, or seriously destabilize/destroy fundamental political, constitutional, economic, or social structures."; which would fit, but is ultimately the prosecutions decision on charging that specific law in the indictment; which doesn't seem to be the case in that specific trial.

I'm interested in how that case is going to turn out, this was speculation on how it might turn out based on the known facts, including dutch legislation; and the facts if he isnt charged with 83a WvSr is a maximum of 4 years - with the prosecution not going for a higher aim likely because the reporters and the police women that acted as source fucked it up increasing the risk too much for any shyster being easily able to get him out on no charges.

I went through the available sources on the case against Justin B again and it reaffirmed my hate against the "profession" of "journalism".

Unfortunately I was unable to find any primary documents on the ACTUAL charges, they are either not yet available in accordance with Dutch privacy laws, or I am too stupid to find them in the Brabant justice database. If anybody finds them whose Dutch is better than mine, please post.
If the "journalist" from omroepbrabant.nl, Willem-Jan Joachems, that seems to be the "original" secondary source every other "journalist" seems to copy paste from, quotes the prosecution correctly, Art 83a is part of the charges - which would be an interesting deviation from European cases against individuals that have been trialed in connection with 09A/NLM/MKY/764.... which of course is no guarantee that it is going to stick and in my opinion an extreme high risk, as the prosecution needs to prove beyond a doubt not just that Justin is a sadistic faggot but also a terrorist.

Anyway, for the sake of documentation STOP REPRODUCING journalistic "sources" and larping as if they were valuable primary sources, they are not, they are crap.
 
I hope they can get the terrorism charges to stick, since that's the only way they could realistically get a prison sentence longer than a few years. EU laws are comically lenient, especially when it comes to child sexual abuse. In the case of Dutch criminal law for example, even if you commit a shit ton of offences, they only give you a prison term for the heaviest singular offence, with the option to add 33% on top of that maximum, which rarely happens. So you can theoretically be involved with dozens of grooming charges (which carry a maximum penalty of two years in prison) and spreading CP (maximum sentence of 4 years) and you'll only be looking at a max of 6 years in prison, which you probably won't even have to serve in its entirety even if you do receive that sentence. I'm not sure about the specifics of other EU countries, but I'm pretty sure it's similar as from what I've seen they've given CVLT/764/NLM members sentences of around 3-7 years.
