None of them were hit with a lawsuit yet, but Palworld is by far their most successful project. I wouldn't say they are safe from a lawsuit, nor is their dismissal confirmed. However, I'm sure it'll get settled and redesign some of the monsters while the game stands. That being said, it's good to see Game Freak getting competition.

The only common thing crypto and AI shares is the hardware they run on being a consumer grade GPU. if "this game looks similar to another game" is grounds for a lawsuit, there would be endless lawsuits in the video game industry.
It's not even like pokemon was the first to do it. Lufia 2 released a year prior to the pokemon games and featured capturing monsters, leveling them up, evolving, and using them in combat. I doubt it's anywhere near the first example, just a well-known game that comes to mind. Hell, they were even based on elements and called "capsule monsters":

Keep in mind that the most publicly accessible AI last year looked like this. Considering there are reports that the dev team had no idea how to do source control or what a rig was, this is probably the extent that they had to work with when they started development if they did use AI
