Alec Baldwin's 'prop firearm' kills one, injures another

Actor Alec Baldwin discharged a "prop firearm" that killed a cinematographer and injured a the director of the movie Rust, being filmed on a set south of Santa Fe, a county sheriff's office spokesman said late Thursday.

Halyna Hutchins, 42 and the director of photography for the movie, died at University of New Mexico Hospital in Albuquerque. The film's director, Joel Souza, was hospitalized in Santa Fe, Santa Fe County Sheriff's Office spokesman Juan Ríos said.

A source closed to the investigation said Baldwin, 63, was questioned by investigators late Thursday and was seen by a New Mexican reporter and photographer in tears.

Investigators are still trying to determine if the incident was an accident, Ríos said. No charges have been filed, and the investigation remains open, Ríos wrote in a news release.

The prop was fired at Bonanza Creek Ranch, where filming was underway, the sheriff's office said in an early evening news release. Baldwin stars in the production.

Hutchins died from her injuries after she was flown to University of New Mexico Hospital, according to the sheriff's office. Souza was taken to Christus St. Vincent Regional Medical Center, where he is receiving emergency care, the sheriff's office said. Attempts to get comment from Baldwin were unsuccessful.

“We received the devastating news this evening, that one of our members, Halyna Hutchins, the Director of Photography on a production called ‘Rust’ in New Mexico died from injuries sustained on the set,” John Lindley, the president of the International Cinematographers Guild Local 600, and Rebecca Rhine, the executive director, said in a statement, as reported by Variety. “The details are unclear at this moment, but we are working to learn more, and we support a full investigation into this tragic event. This is a terrible loss, and we mourn the passing of a member of our Guild’s family.”

Deputies were investigating how the accident occurred and "what type of projectile was discharged," the sheriff's office said in an earlier news release.

Rust Movie Productions did not immediately respond to requests for comment.

Filming for Rust was set to continue into early November, according to a news release from the New Mexico Film Office. It's described as the story of a 13-year-old boy left to fend for himself and his younger brother following the death of their parents in 1880s Kansas, with New Mexico doubling for Kansas.

Guns firing blanks have been blamed for deaths in past movie productions. Online Hollywood news site Deadline reported, "Actor Jon-Erik Hexum was killed Oct. 18, 1984, on the set of the TV series Cover Up when he accidentally shot himself in the head with a gun loaded with blanks. And in 1993, Brandon Lee, the son of martial arts legend Bruce Lee, died after he was shot in the head by a gun firing blanks on the set of The Crow. Both incidents were determined to have been accidents."

the only time i've ever done something like that for a production was when it was a prop bandoleer or on a table or something, not to be mixed with real ammo that might be loaded into something. they are like that merely look the part. this is because drilled dummy rounds or blanks are pretty obvious to someone that sees them.

My guess is they had a ton of these on hand specifically for belts. According to the article one of the live rounds was in Baldwin’s belt. The article makes it sound like the dummy rounds in the gun were this type. That makes it look like they didn’t have any other kinds.

I thought I'd pop back in and check this thread out after a hiatus to see what has transpired.

Not much. Except more evidence suggesting (through texts) that the armorer has as one would expect more questions to answer. And of course Baldwin has showed negligence in safety but I haven't seen enough to meet the threshold for criminal negligence.

I'd expect the Sheriffs office to possibly request charges by end of June, with the target being probably the armorer.

Sadly for the Baldwin wish-him-dead-squad he will not be charged with manslaughter. But, if the armorer is not charged either then I think the DA will have to attempt to send it to a grand jury with either the armorer or Baldwin as parties. The DA not to file any charges would probably cause an uproar (rightly so).

If I were on a grand jury for the Armorer or Baldwin I'd suggest a trial based on the evidence we've been made aware of, and perhaps it deserves the judgement of peers to determine; and I give the armorer an 80-90% chance of conviction and Baldwin less than 5%.

Of course, someone IS LYING to the police and withholding evidence as the trail of the live round has not been answered - so there is actually someone who is lying to the police and it is not Baldwin, but either the armorer, Halls or someone else. But Someone is lying and covering tracks about the crucial element - the live round. I find the behavior of Baldwins assistant Dale Halls to be highly suspect in all this. I find the armorer to be an idiot capable of making mistakes based on the data provided, but I find David Hall capable of being intelligent enough to know he did something and then covering it up. Either way, someone is lying their asses off to the police, but I do not think it is Baldwin.
 

The gun used in the fatal shooting on the "Rust" movie set could not have been fired without pulling the trigger, according to an FBI forensic report obtained Friday by ABC News.

So, baldwin absolutely did pull the trigger and has been caught red handed lying through his teeth:

In an interview with ABC's George Stephanopoulos in December, Baldwin said he didn't pull the trigger on the gun.

"The trigger wasn't pulled," he said. "I didn't pull the trigger."

"Death was caused by a gunshot wound of the chest. Review of available law enforcement reports showed no compelling demonstration that the firearm was intentionally loaded with live ammunition on set," the report stated. "Based on all available information, including the absence of obvious intent to cause harm or death, the manner of death is best classified as accident.”

Except it was intentionally loaded with live ammunition on set, due to incompetence of the idiot in charge of handling the munitions and the trigger was deliberately pulled and at best this is negligence causing death not an accident

I'd be pretty paranoid about that even if obvious though. These are Hollywood actors we're talking about here.

Who loaded it and why is irrelevant, and we have case law that is perfectly in point from that states supreme court which clearly states that regardless of who loaded the gun or when, criminal liability is fixed in the person with the gun in their hand at the time of shooting.

Found it: State v. Gilliam, 288 P.2d 675 (New Mexico Sup. Ct. 1955)
The decision was an appeal of a criminal conviction at a jury trial, in which the defendant had been found guilty of involuntary manslaughter by the act of unsafely handling a gun with the result that it discharged and killed the victim.

The NM Supreme Court ruled in that decision, in relevant part that:
It could have made no difference to the trial of a charge of involuntary manslaughter as to who loaded the gun … . All that it is necessary to establish for involuntary manslaughter by the use of a loaded firearm is that a defendant had in his hands a gun which at some time had been loaded and that he handled it … without due caution and circumspection and that death resulted.
Pointing a gun at someone and pulling the trigger counts as 'handling without due caution and circumspection'.
 
Reading the CBS version and came across this bit:
Detectives from the Suffolk County Police Department in New York, where Baldwin has a home, are also aiding in the investigation, and are working to obtain, process and disclose Baldwin's phone records, the sheriff's office said. Those records are forthcoming.


"The district attorney's office has been working with Suffolk County PD, and Baldwin's lawyer, to acquire the phone records," Santa Fe County Sheriff Adan Mendoza said in a statement. "Once Suffolk County PD completes its agency assist and sends those records to New Mexico law enforcement, our detectives will need to then thoroughly review those phone records for evidentiary purposes."

Baldwin surrendered his phone to Suffolk PD almost 7 months to the day. If that didn't contain the records they want and they need shit directly from the phone company or someone else how have they either not had him turn it over voluntarily or gotten another fucking warrant by now?

I’m thinking that given the lack of malice, and the unusual/extenuating circumstances, Baldwin will likely be charged with involuntary manslaughter. But I sincerely doubt he’ll see prison time, and it’s not impossible that he turns this whole thing into a charity or PAC, ‘The Baldwin campaign for sensible gun laws’ or something.

Sounds like the FBI is giving him exactly what he needs to claim a malfunction occurred. Baldwins lawyer will be all over that one

The Santa Fe County District Attorney’s Office has said that up to four people, including the actor Alec Baldwin, could be charged in the fatal shooting of a cinematographer on the set of the film “Rust” last year if prosecutors decide criminal charges are warranted.
The district attorney’s office speculated on the possible charges in a request to state officials late last month that asked for additional funding to cover the costs that would be incurred if charges were brought, which would result in several high-profile trials.
While the district attorney, Mary Carmack-Altwies, made it clear in her funding request that her office had not yet decided whether to bring charges — “If charges are warranted,” she began one sentence — the funding request also went into greater detail than she has in the past, noting that her office could charge up to four people.
A document attached to the funding request said, “One of the possible defendants is well-known movie actor Alec Baldwin.”
