Alec Baldwin's 'prop firearm' kills one, injures another

Actor Alec Baldwin discharged a "prop firearm" that killed a cinematographer and injured a the director of the movie Rust, being filmed on a set south of Santa Fe, a county sheriff's office spokesman said late Thursday.

Halyna Hutchins, 42 and the director of photography for the movie, died at University of New Mexico Hospital in Albuquerque. The film's director, Joel Souza, was hospitalized in Santa Fe, Santa Fe County Sheriff's Office spokesman Juan Ríos said.

A source closed to the investigation said Baldwin, 63, was questioned by investigators late Thursday and was seen by a New Mexican reporter and photographer in tears.

Investigators are still trying to determine if the incident was an accident, Ríos said. No charges have been filed, and the investigation remains open, Ríos wrote in a news release.

The prop was fired at Bonanza Creek Ranch, where filming was underway, the sheriff's office said in an early evening news release. Baldwin stars in the production.

Hutchins died from her injuries after she was flown to University of New Mexico Hospital, according to the sheriff's office. Souza was taken to Christus St. Vincent Regional Medical Center, where he is receiving emergency care, the sheriff's office said. Attempts to get comment from Baldwin were unsuccessful.

“We received the devastating news this evening, that one of our members, Halyna Hutchins, the Director of Photography on a production called ‘Rust’ in New Mexico died from injuries sustained on the set,” John Lindley, the president of the International Cinematographers Guild Local 600, and Rebecca Rhine, the executive director, said in a statement, as reported by Variety. “The details are unclear at this moment, but we are working to learn more, and we support a full investigation into this tragic event. This is a terrible loss, and we mourn the passing of a member of our Guild’s family.”

Deputies were investigating how the accident occurred and "what type of projectile was discharged," the sheriff's office said in an earlier news release.

Rust Movie Productions did not immediately respond to requests for comment.

Filming for Rust was set to continue into early November, according to a news release from the New Mexico Film Office. It's described as the story of a 13-year-old boy left to fend for himself and his younger brother following the death of their parents in 1880s Kansas, with New Mexico doubling for Kansas.

Guns firing blanks have been blamed for deaths in past movie productions. Online Hollywood news site Deadline reported, "Actor Jon-Erik Hexum was killed Oct. 18, 1984, on the set of the TV series Cover Up when he accidentally shot himself in the head with a gun loaded with blanks. And in 1993, Brandon Lee, the son of martial arts legend Bruce Lee, died after he was shot in the head by a gun firing blanks on the set of The Crow. Both incidents were determined to have been accidents."

This is a developing story and will be updated.
 
Various sources are reporting new details; but without an affidavit to actually view it is hard to tell if they are legitimate or not.

The scene painted by some sources is that the guns were prepared and set aside. There was a lunch or other downtime. There was also some use of live ammunition for shits and giggles with tin cans also on the day during downtime or during that period where the guns were set out; but prior to use.

Of an alarming note, it is saying immediately after the shooting the Armourer Hannah REMOVED the casings from the gun.

It will be interesting to see if Hannah allowed one of the guns that was set aside for prop as one of the guns used in the "plinking" (shooting of tin cans) and then returned the gun to the spot; and left munitions within the gun. It appears from some reports this is what in fact happened.

Either way the profile of the Assistant Director is coming up as a source not to the same extent as the Armourer, but judging from reports, we will soon find out if he violated protocol not in just not having checked the gun, but also if he was aware the guns had been used for other purposes prior and still not check the guns, which adds a new layer to his culpability in that if he was aware of this, and also did not check the gun then his liability in this goes to a new level.

Judging from the loose reports the munition was likely lodged in the chamber or cocked ready to go.

There is a certain irony that there may not actually be video footage of what happened with the guns moments before the fatal incident...on a film set of all places.

Apparently there will be a news conference on Wednesday where the police are going to give a briefing on wha happened in some detail. I get the feeling not only will Hannah see a hanging from this, the the Assistant Director is also going to be pretty deep in liability on this as well if these reports hold true on the events.

Alan Dershowitz talks the legalities of Baldwin shooting...​

Alan Dershowitz, an emeritus law professor at Harvard, is one of the greatest legal minds of our time, writing multiple books and publishing hundreds of articles about the law. He has been defending clients in courtrooms since the 1970s and argued numerous cases before the Supreme Court. He was also on the team that defended Donald Trump against impeachment.
Alan Dershowitz believes that Alec Baldwin’s shooting of Halyna Hutchins could be considered a homicide. Gun safety protocols are so stringent that an accident of this kind is almost impossible. Armando Gutierrez recalls that on the set of Purge of Kingdoms, “weapons went through maybe 10 people before any actor was handed anything.” Prop masters must be licensed, secure permits, and go through strict procedures on set that ensure everyone’s safety.

Some of the protocols include keeping weapons in a safe. Then, when the armorer removes a weapon from the safe, he or she checks it for ammunition. After that, the armorer hands the weapon off to the prop master, who also checks for ammunition. The weapon is checked again on the set. For rehearsals, the actors use only non-working replicas, and the prop master or armorer does not load the gun with blanks until the scene is ready to be filmed. When the armorer finally loads the gun with blanks, he or she uses only the exact number of blanks required for the scene.

When the actor is handed the gun, there is a general warning that the gun is hot so that everyone on the set is aware of the weapon’s status. If any adjustment is needed to the scene, the prop master or armorer takes the weapon back. As soon as the scene is done, the prop master or armorer secures the weapon. Weapons are never to be loaded with live ammunition. In fact, live ammunition should never be on the set at all.

Dershowitz is of the opinion that, since it appears that the people working on Rust, from the armorer to Baldwin himself, didn’t follow these protocols, Halyna Hutchins’s death could rise to homicide. Ultimately, it was Alec Baldwin who chose not to follow the first rule of gun safety: A gun is always loaded and you don’t point it at anything you don’t intend to shoot.
It is possible that even if there is criminal liability, there may not be enough evidence to prove guilt. That is Dershowitz’s opinion. I do not share that opinion. I believe Baldwin is guilty of reckless endangerment, due to his woeful lack of gun safety and the penny pinching that deprived the crew of the strict (and expensive) regulations that govern filmmaking on Hollywood sets.
However, I do believe Dershowitz is correct when he states that, going forward, legal measures must be in place to ensure that gun safety protocols are followed. I also believe that legal penalties will be applied against people like Alec Baldwin who ignore the rules of gun safety or despise guns so much they never bother to learn those rules.
 
This may be very poor taste, but I think the armorer hannah Gutierrez-Reed is worthy of own Lolcow thread. Gross incompetence, listed as a master armorer after working on only one other movie , was previously doing "alt modeling" and "findom".

I was raised partially on TV and I still ditched it ten years ago and haven't look back since. Its gotten so much fucking worse too, there's literally nothing attractive at all about TV anymore.
i still have a tv. i play playstation and watch my streaming services on it.
its just not as comfy to do that on a computer monitor. just like shooting another actor on set, its not comfy.
with a tv, i can sit back on the couch, eat some snacks and watch a movie or show i like.

Sounds more like nepotism, in that she's the daughter of a well known Hollywood armorer, but several interviews have shown her to be critically inexperienced, while her life so far has shown her to have very poor judgement.

For me this is the biggest question, if there is no footage then it means that between shots Alec Baldwin aimed a gun at the staff as a joke and pulled the trigger, which, if it isn't, should be illegal and at least a case of severe insanity with the actor.
The only alternative I can think of is that it was some sort of dry take.

What am I asking, of course it's too much. All that safe handling shit is for help and for NRA extremists.

If I were to do the same thing, I would immediately be charged with manslaughter, because I'm not Alec Baldwin. Hell, I'd be in jail if I did so because Jamal was about to brain me.

The lack of charges against Baldwin is just more proof of our two-tiered judicial (I refuse to call it justice) system.

well its moot now. he could have done all that, but he wouldnt, he didnt and now he paying the price.

“Armorer” is one of those jobs where you want to lean hard into stereotype accuracy and only hire middle aged dads with non-ironic mustaches and eagle-globe-anchor tattoos who don’t mind telling people, “No, you’re doing that wrong” all day.

Until now, the fictions of affirmative action and “equality” have been maintained having enough competent white men on hand to carry the dead weight of the stupid and the incompetent. But we’re rapidly approaching — if not already at — the point where white men have been purged to the extent that this is no longer possible. Having clueless little girls LARPing as armorers — and as sailors, cops, journalists, professors, senators, and vice-presidents — is starting to have negative real-world consequences.

I made this point to a retired corrections officer once, and he related a story where they had to do a “cell extraction” on a big, muscular black inmate who was freaking out in his cell (possibly on drugs). The guy had trashed his cell, stripped naked, covered himself with soap to make himself slippery, snarling and foaming at the mouth, and wanted to fight the COs.

Three male COs and a female CO with a reputation for being incompetent responded. One of the male COs said “OK, here’s what we’re going to do.” To the female he said “You go in there first, and then we’ll go in and grab his arms and legs.”

The female CO blanched. “I’m not going in there!” The male looked at her and said “You make the same paycheck as me, don’t you?”

Ultimately the male COs, who were all big, dumb football player types able (and willing) to fight, handled the situation.

Moral of the story: Once guys like that are are gone… reality will kick in and it won’t be pretty.
More routinely, we had a house fire close to twenty years back now. Nothing horrific, but a year of bullshit thereafter.

Anyway, the fire department shows up with three guys and three gals. It worked — but it was hard not to notice something.

The three guys fought the fire. The three gals consoled the family.

This — if it’s understood, and matters are arranged accordingly — actually isn’t too bad a system. However, the pretense is otherwise.

Knowing Baldwin, she checked all the critical boxes. She was diverse, carried a family name that gave respectability for the money people and most importantly she was dirt cheap as she was completely inexperienced and would work for almost nothing just for the film credit to build her resume.

Jeffrey Wright didn't say he checked the weapon himself, he is saying he made sure it was checked in front of him but the armorer was handling the weapon. Ray Liotta is saying the same thing.

While I agree on the reasons, specifically hiring her is probably the one thing I don't figure Baldwin is directly responsible for; most likely that fuckup belongs to one of the other dangerhair types doing HR for the production.

Edit: I heard something about Gutierrez being a current/past Suicide Girl, but I haven't really looked. Wouldn't surprise me at all.

I don’t know if this has been mentioned. But apparently the Assistant Director who declared “cold gun” had been fired off another movie for dangerous gun safety violations.
the plot thickens and gets even more stupid and negligent. Talk about setting up a movie to end in bloodshed.
