When her former caretaker Hannah went on the Dad Challenge Podcast, one of the things she mentioned was that Cairo was not being adequately cared for.

At some point, Cairo stopped appearing in her social media content, and she eventually admitted that he was back with the Smiths. I'm not mad about that part, because the Smiths appear to really love animals, and all of their appear to be cared for. Cairo also went nuts with happiness when she moved in with them: he loved their yard and loved having other dogs to play with. Of course, if you can't care for a dog, then maybe you shouldn't have a child in your care, but that's another story.

Grabbing Ari and moving out of state is a risky move. Noah could easily file in court to force them to move back, or at the very least make Alex be responsible for paying travel costs for visitation. Judges tend to frown on parents absconding with their kids.
"Noah's not on the birth certificate" doesn't mean anything since they already established paternity through a paternity test.
They seem to want to stay out of court for the moment, which is understandable, but there's nothing to protect either of them if one or the other decides to fuck off to another state or just not give Ari back after a visit. Noah could just grab Ari and go upstairs, and Alex would have no recourse.

Right now though, if Noah goes to a lawyer, Alex is 100% fucked for absconding with Ari. Even if Alex files in court in Illinois right this instant, Ari's been in Florida for too long and would be considered a resident.

In fact, their lawyer told them that a judge wouldn't take their claims as seriously if they didnt try to get the kid as far away from the abusive parent as possible. So who knows. Family court is notoriously fucked up.

Well, Noah hasn't shown himself to be a danger to Ari. An asshole to Alex, yeah, abusive but maybe not criminally so, and family court is fucked up enough to think that Alex is just trying to retaliate by going to the police a month after he left and right when he found a new girlfriend.

Plus family court likes to give the other parent a chance. Some people are pieces of shit and don't want anything to do with their kid when they're born, but according to them people can change their minds and see the light! Even years later! They can disappear for 10 years and suddenly decide that they need to be a part of the kid's life... And if the court orders it, everyone has to go along with it.

Noah can seriously and legally fuck with Alex just by wanting to see his kid. And maybe he should.
