I was watching older tv shoes recently. Like The Wire and True Detective. The characters (especially the blacks) joke about prison rape. The season 3 true detective, uh, detective, is extremely blunt with it.


That's just one example. There's one or two even more extreme examples in the show I cant find.
Don't forget Prison Rape the Series, Oz (which was also on HBO).


Jokes about prison rape are so common in American media we mutts just assume it comes as part of the punishment. It wasn't until recently when twitter fags would pop up to tell us how offensive it is to joke about white cornholes violated by BBC because they made poor choices in life.

People think that all the movies about prison/jail represent the actual reality of being incarcerated, basically. I don't expect Baked Alaska to do much more than sit on his fat white trash ass and be bored out of his mind for a few months at most. County jails in particular tend to be very secure places with guards that don't tolerate bullshit.

And they can cut a deal any time before that is resolved. A deal can generally be cut any time before the imposition of a sentence. Up until then, the case is not final.

Aggravated sentencing means an upward departure and mitigation is a downward departure from the sentencing guidelines.

Someone a friend of mine knows pleaded guilty to manslaughter after murdering a guy over nothing (booze) and they let him plea down to voluntary manslaughter. He served 6 years for pointlessly murdering another person.

Except he has no more leverage. The whole reason they hand out light plea deals before trial is it saves the state a ton of money and guarantees the DAs can wrack up free guilty verdicts to pad their stats. They already got their guilty and they already wasted two full days in court. Why the fuck would they cut him a plea deal now?

So they don't have to waste another full day. He's probably too arrogant to take it even if they offer something almost as good as they did last time, though, which they'd have to be retarded to do, but they could. I have just so many fucking retards get away with slaps on the wrist after pulling stunts like this that I wouldn't rule it out.

Sorta, but not exactly. It is to save money, but really, resources are more of a limiting factor. Realistically, they could never actually take every case to trial even if they wanted to; there aren't enough courts or prosecuting attorneys to do that. So instead, punishments after a guilty verdict are pretty much set up to be far harsher than the state actually thinks the crime warrants, so as to encourage plea deals. So they just threaten you with a year in jail when they'd really be fine with 90 days, then it seems like you got a bargain when they offer you 120. That's not cynical, that's just a fact, although note above, resources are also a huge bottleneck. Most criminals are guilty anyway. The one real issue with plea deals that is bad, other than the occasional guilty person getting a ridiculously cushy deal, is when innocent people are faced with having to plead guilty to something or risk going away for life for some heinous crime they didn't commit.

Is there any reason why someone would plead guilty as a part of a plea deal instead of no contest?

I would think doing the former would disqualify you for options further down the line like appeals.
