The legal system is it's own world. It's full of jewish tricks and black magic. It's also theatrical to the point of being cringe - watch 10 DUI cases go in front of a judge and suddenly you learn that every single one is a remorseful recovering addict who AA's regularly and gettin dey act together n' sheeit.
You can go in front of one judge and he'll try to throw the book at you, decline to plead out after learning the sentence (apparently you can do this once in a certain situation), then go in front of another judge that will grant a much more lenient sentence for the same exact crimes. A good lawyer will schedule you with an easy judge on purpose.
You might go in front of a judge with your expensive lawyer, and fancy that... your lawyer plays golf with the judge, and believe it or not the prosecutor hag is actually an old friend of his, so your lawyer tells the prosecutor to softball her questions por favor and the judge pretends to be very stern and serious and all that shit but really you know you're gonna walk.
Jury trials select literal retards to decide on your fate. Imagine having your fate in the hands of a cross-section of the general population, and on top of that selected for people who have nothing better to do and no imagination to make an excuse (this usually means they're not very capable and don't earn much money or produce anything).
Anyways there's basically a kind of grace period for most people who get involved with the criminal justice system. Someone might bounce in and out of court a dozen times for petty bullshit and idiocy, catching fines and probations. Sometimes they'll slide on things you might consider shocking, for a million different reasons including plain ol' bureaucratic incompetence. This is one of the reasons it seems like rich people and white collars always get off, because they're (technically) first offenders and believe it or not, most people get a break the first time around.
But for recidivists, the lucky sauce runs out. Careerists sometimes prefer not to take probation or suspended sentence, because probation is considered a trap, and they can serve a year in jail and be free n' clear instead of 3 on probation or 2 suspended, where they're gonna violate because they won't stop fucking up. Arrest sheets build up until reaching comical proportions. The police stop and search you because they know you're a piece of shit. The DA sends his best ADA to prosecute because you make him sick. The judge lost any doubts about you after seeing you 4 times in a year. You have prior convictions. Suddenly, probation isn't being offered anymore. Prosecution is seeking 3-5 and they have a damn good case.
