§371. Conspiracy to commit offense or to defraud United States​

If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both.

If, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such misdemeanor.

I'm still unclear as to how a bunch of gay revolutionary LARPers taking Ivan's advice and money amounts to "conspir[ing] either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose".

Generally, taking money from a foreign power, particularly, the intelligence branch of a foreign power, to spread disinformation is considered adjacent to treason if not actually treason.

And let me guess, the government bears no burden of proof to demonstrate that 1) this guy was actually foreign intelligence as opposed to some random Adidas enjoyer or 2) that the information he wanted them to propagate was false in any meaningful way.

It's illegal in general to take money from a foreign power to spread propaganda. If you are being paid by a foreign government to engage in political activities of any sort, it is a felony to fail to register as such under the Foreign Agent Registration Act, so he'd be guilty of something just for that alone.

I get that part, but doesn't "taking money from a foreign power" logically require proving that the foreigner in question is some sort of government agent? Or does anyone who gets a superchat from Vodka Drunkinski need to register as a Russian agent?

As with all crimes there's a material element and a mental element (mens rea). A grand jury generally doesn't get that deep into it, though, they just indict. Are you charged with murder? Are you a ham sandwich? INDICTED! Then the prosecution has to prove its case.

I don't think this is a meeting where Gazi introduces himself with a pair of twink guards but it was clear when he did show up the guy had charisma enough to run a cult. The organization was full larp with weekly book clubs, self defense classes, opsec courses all taught on Facebook. Had a few weeks of stuff but it was all lost in a drive crash and then the organization crashed after his arrest. So much potential lost like tears in the rain.
