If there's a copyright, yes you can still pirate a free game, for example a paid game that becomes free for a sale. Is it stupid, yes, but copyright law is a fucking jumbled bunch of garbage that benefits no one.

Yes, a private server giving you Cash Shop stuff for free like that which exists for MapleStory or GunZ is basically pirating a free game, or at least the paid parts of it.
