I'm pretty sure he's wrong and I don't know who started this rumor, but under Virginia law he would have been housed in the prison which matches his genitals, regardless of whether or not the state of Virginia allowed him to change his sex on his state ID.

There are cases of actual male inmates being housed with women, such as in California, but Chris' incident isn't one of them.

For starters, the diagnostic criteria for autism do not mention empathy once.

No but it does mention theory of mind and theory of mind is fundamental to grasping how another person thinks and feels. It's a fundamental deficit in autism. It isn't necessary and most high functioning spergs do have to figure it out. Sympathy would be understanding how you'd feel in a certain situation and feeling bad for someone because of it, but empathy requires an actual grasp of how it would feel to that specific person.

It's entirely possible for a non-profoundly disabled autistic person deliberately to learn theory of mind, so lack of empathy is not a necessary criterion for it, because there are autistic people who have that skill. It's just more difficult and requires some actual effort.

This isn't an "autists are automatically bad people" shitpost, it's just a characteristic of the disorder to have difficulty with this particular issue.

It is his lawyer's job to talk him out of doing that, and also to keep him off the witness stand. This would be precisely the same for any "obviously guilty" felon, not just an extra-creepy case like this one.

Of course if Chris is manic enough he could fire his counsel and defend himself, but not if he's already been found mentally incompetent.

The lawyer's job isn't to get him off, it's to get the best deal possible. Knowing what's possible in a case like this is not obvious, but it's clear Chris will never be a free "woman" (or whatever).
