You know, I personally think its unlikely but does anyone think that the defense might use the "relentless years of online abuse against this poor autistic wahmen" card? And actually show evidence like some of the videos Chris made in the past?

Part of me think that its retarded and the courts will never do something like that
Part of me thinks that the courts are retarded and they would totally do something like that
 
It was an arraignment. Preliminary hearing is September 19. Often defendants waive this but I'm making a wild guess this won't happen in this case, even though nobody wins a preliminary hearing. Among other things I suspect will happen is exactly what @Jesus H Christ said, raising the issue of competency to stand trial. He could be found incompetent, especially if the mental evaluation comes back supporting that.

Note that this is an entirely separate issue from whether he's not guilty by reason of insanity. While the bar is low for competency to stand trial, courts often err in favor of a slight delay to make sure of the issue rather than risk a reversal on appeal. What happens then is Chris either gets sent into treatment in some kind of mental health facility until it is determined he is now competent, or possibly into some treatment ward of a jail.

A good thing for the defense about delay is in this case, Barb might die or go even more senile to the point of being incapable of testifying, if she isn't already. It's almost always the case that delays favor the defense. Memories fade, so do grudges, evidence somehow ends up lost, the prosecution might come to the table to get this miserable case behind them, etc., but in the case where it's fairly likely the prosecution's lead witness outright dies or becomes too senile to testify in the near future, it's worth throwing as many monkey wrenches into the system as possible.

On the good side for Chris, and what his attorney will probably decide, is that getting Chris out of that jail into a treatment facility until trial is the best outcome he can get for his client in the short term.

In short, I'm fairly sure the defense will file that motion.

In any event, the process from here on out is the preliminary hearing will determine whether there's probable cause and whether the probable cause is for a misdemeanor or felony. In the event it is a felony, it will be certified to the grand jury. If the grand jury agrees (which it will), an indictment is issued and then the fun starts in earnest.
but that's the catch, isn't it? they get put in a treatment facility for x duration until they're fit to stand trial and then they get sentenced. i'm ignorant of virginia law in regards to the statuette of limitations for sex crimes but in most places there doesn't seem to be one, especially when there's the possibility of physical evidence, and also the possibility of barb being deemed unable to consent

If they did then I'm sure that it would be what they use for an insanity defense.

It's not going to happen. The insanity defense is not "this person has a mental illness so they aren't accountable", it's that "this mental illness or defect made them unable to understand right from wrong in this specific situation." Since Chris took steps to conceal what occurred (even though it was hamfisted and didn't work), that's a good sign he understood it was wrong. He's also discussed the legality of incest before, so he's aware it was bad.

Yes, and I don't think it will sway the jury in Chris's favor. They might end up going big brain and declare Chris guilty to protect him from trolls.

He's also absolutely physically repulsive. He's way more likely to get stomped than raped, and even that is unlikely because he's such an obvious target he'll be in pc.

It definitely happens but it's way more likely to happen if you're a skinny twink type they can pretend is a woman because prison rapists are generally straight. It's still much less common than it used to be because of numerous scandals about it in the last few decades.

Am I correct to assume that after short term Care he'd be turned out into the wilderness with only weens and Tugboat to help him?

Chris is very tail end gen xers teetering on the millienial label. Because of his birthyear being 1982.

Yeah, they covered this day one of crim law during 1L year. The extra dimensional entity possession defense. One of the gunners asked what would happen if our grandmothers were already did. The profs answer haunts me to this day.

Years ago I worked for a bail bonding company - the charges listed were almost always the result of the clients get caught doing something they should've never been caught doing (DUI/reckless driving) being compounded by other obviously stupid actions (drug possession, illegal weapon possesion, and more often than not fleeing and resisting arrest)
I know someone who fits this profile, minus the weapons and attacking cops shit. He's a great guy, a great mechanic who can fix anything when he is sober, but has DUI after DUI. And when he was let out as the sole caretaker of his mom, but with his license suspended, he got another DUI after a head-on collision where it is a miracle nobody died, and went right back to prison.

The main characteristic almost all prisoners seem to have isn't being evil but just having incredibly poor judgment.

yeah ya know i always found this whole "generations" thing bullshit anyways the point is Chris wound up as a degenerate and nothing but a burden to the hard working folk of virgina. Cause all those years of leeching of the tugboat while running amok in Charloesville was on their dime. Ironically regardless of where he ends up he'll STILL be a drain on society and living off the working man's dime. Tard Home/nuthouse? paid by taxes same for jail/prison. and you just know he won't go any work details willingly. and it's considered unethical to force inmates to work off their debt to society.
