Hey Alex, sorry if this has already been answered, but how long could he be in jail pending trial/investigation? Is there a minimum time before they bring proceedings forward?
It really depends on whether he's the one delaying it or the prosecution. The prosecution is limited by the right to a "speedy" trial. In Virginia that means five months (for people behind bars) from indictment or preliminary hearing. But it is often the defense that delays a trial, and one can generally waive this right.

So it is entirely possible it is Chris's defense team that delays the trial. And that has certainly been the trend in the past.
One of the very rare occasions I've actually gone to trial on a criminal case was when the offer from the prosecutor was just the presumptive sentence. There's supposed to be bait on the hook! My client was a lady in her 80s with no criminal history, as well.
Why would anyone even make an offer like that? He thought you were a sucker? He was that confident?

I have seen that kind of shit where the case was just a total slam dunk and it was let's just save time and get done with it, but you are describing a case where the son of a bitch lost.

If the Cops are arresting you for Fucking Your Mom, you should never ever declare unprompted, on Camera, Live in front of the internet, in front several clearly identified uniformed officers “Null told me to Fuck My Mom” or some variation thereof. It’s really not gonna help.

And Chris has played this continuance continuance continuance followed by a nothing sentence game repeatedly before. It has always worked for him. This case is probably different but don't be amazed if it happens again.

Millennial female prosecutor in a blue state (albeit a not-so-blue county, but my impression is that even in red counties the DDAs tend more blue) when there were allegations of a racial aspect to the crime (still just unconsented physical contact, not even violent, I've seen far softer offers on actual violence).
 
How much difference will it make if Barb's attitude is "please spare my poor son"? I understand that they don't legally need her permission, but I'm talking more about prosecutorial discretion.

I'm one too, but I got the sense she was fired up by The Mission on this one.

In a related note, one of the DDAs got reprimanded a while back for making a DWA joke during an internal meeting, even though she's part-Asian and I doubt there were any full Asians there to take offense. And like I said, this is in a relatively red county.

I'm pretty sure he's actually going to be behind bars for longer than any other time in the past. He has no home now. He has no place to go. He even openly had plans to go all the way to Washington State recently. He has no ties in the community, other than to his mom, who he's more or less prohibited from approaching.

He's pretty obviously a flight risk at this point.

As was said in a previous post, cases like this take a very long time. Since Chris doesn't really have anyone to bail him out (if/when it's issued), is there a possibility he can be released on his own recognizance? Or will he likely have to spend the duration of the investigation and case in jail?

I'm not a lawyer and don't know how jails do things in Virginia, but generally to be ROR'd on a felony you have to prove that you're employed, furnish character references, and tell the sheriff's department where they can find you. Chris can do none of these things. Also he already has a record and has been removed from 14BC so there's no fucking way he'll get out of jail before the case is finished.

You're certainly not wrong about any of this. It's entirely possible there is mixing of funds going on. The issue is that Chris seems to acknowledge it's not his money - he told Null he intended to pay it back, not 'Oh that's mine' and acknowledged having control of Barb's account. Also from what I've seen he has his own. A big thing this turns on will be whether both their names are on the account or just hers.

I know this is old and on a thread moving at the speed of autism, but another factor here is that Chris was panicing when he said 'i'll pay it back when my other money comes'. He had just been caught in a lie to Null, the only one who was still helping him, and he may have thought that Null was more pissed that he suddenly had money when he said he was broke rather then lying to him, and that Null might not release the funds now that he had money, and thus panic-responded 'I won't have $1750, I'll be putting this back!'

He may well not at all have intended to acknowlege a debt to Barb, just pouring out more excuses to cover his ass.

Best lesson I was ever given was first day in my criminal law class. Professor enters room, writes Shut The Fuck Up on whiteboard. Gives a curt introduction then says if we don’t learn anything else in college to learn SHUT THE FUCK UP when police are communicating in ANY official capacity. The man was not only a professor and lawyer, but active Chief of area municipality.
