They do realize the magic downside to libel suits is when it gets dismissed day one the Plaintiff's often get hit with Defedants attorney fees. That's going to be fun.

This is the THIRD fucking one out of Texas since I've been on the Farms. And the third fucking one that claimed defamation and TI (though "assault" is certainly a new angle).
One draw, one defeat (currently on appeal), and now this.

This is federal court, not Texas state court. The TCPA does not apply at the federal level.

Even if it does, @TESTEFY-HD , how much do you think Preston paid for this? Had to be a couple of thousand. He essentially burned a couple thousand dollars at that point. Even just getting it dismissed may cost Ethan, Vikki, and Dean money because they'll need to respond.

I just can't imagine that a boomer judge is going to have someone explain to him what 'Daz3D' is, explain to him that most of the 'Daz3D modelling community' are pornographers, and when the judge sees the cover art of 'Demonatrix', somehow take from this that, yes, this lawsuit is totally legitimate, and yes, the plaintiffs are definitely well adjusted not-pedos.
If his attorney is aware of that statement and filed this frivolous lawsuit then he or she should be disbarred.

I just want to say right now, regardless of what anybody thinks of @FROG:
I don't think anybody deserves to be sued by pedophile loving pieces of shit like Lamont and Poulter. If anybody hates Ethan so much that they'd want Poulter to win, you're wrong and should consider drinking bleach. Thank you.
And I think @VIkkiVerse and Dean definitely don't deserve it.

My original post on Jon T Lamont can be found here with screenshots of his promotion and discussion of loli images within Preston's discord server. The post additionally leads to archived pages of his deviant art which featured naked images of Koneko Toujou from High School DxD. Koneko Toujou is described as being a second-year high school student and would be roughly between the ages of 14-16 years old.
I also reported on Jon T Lamont's Kickstarter campaign being taken down in a post here, the post and page features the variant covers and an admission from Jon on the campaign page that the main character of his story was under the age of 18. The variant covers also feature the "Comicsgate TM" trademark logo that Preston designed to designate his brand of Comicsgate books.
I'd suggest both @VIkkiVerse, @FROG and DA Talks familiarize themselves with both previous posts and links to prepare for an attorney in their defense. I would stress that considering Jon T Lamont has admitted publicly he enjoys lolicon, had naked images of a cartoon underage girl on his deviant art page and was producing an erotic comic featuring an underage girl, which Preston Poulter has admitted he would publish - putting all these facts together would mean any reasonable person would/could express an opinion that the comic was pedophilic in nature.

It doesn't have to. If you can show a case was brought in bad faith, you can get attorney's fees and/or sanctions even from a U.S. District Court. There are a few well documented exceptions to the classic "American Rule." The "bad faith doctrine" is one of those established in common law.
And given this is Preston, and he has often talked at length about how litigious he is (I distinctly remember him doing it on @TESTEFY-HD's show, and Testefy calling him pathetic), that can come back to bite him in the ass.
Dean actually had the best answer for Preston's comment on that show, BTW. "We know. You like wasting money."
I dunno about that. Professional misconduct is often very narrowly construed. That's another thing we know because there were a gazillion complaints filed against Rekieta during the Vic case. All of them dismissed. There are also punishments less than disbarment, such as censure, fine, or suspension, that hardly anybody who has never worked in law practice seem to bring up. You have to fuck up VERY badly to be outright disbarred, and yet people seem to think you can get a lawyer disbarred if he farts out of order.
Like I said though, Preston could end up opening his wallet before this is over. He deserves, at the very least, to be utterly humiliated.

On a MUCH lighter note, does anybody have an opinion of Keung Lee and Battle Maiden Knuckle Bomb? I did a search on KF, and I really learned little other than the fact he has worked with TUG (but not on this).
I don't like TUG, but this is more my aesthetic. Thinking about maybe seeing if I can pick up a copy. I don't want to do the guilt by association bullshit.

I can assure you this guy did not write this abortion of a lawsuit for free:
It doesn't really matter how much he paid for this on top of the filing fee. I can tell you right now, it's too much. Even if he didn't hire this attorney, and wrote and filed this bullshit pro se, it would still be too much money.
I don't mind people having money, but it irritates me when stupid people have money, and waste it on stupid shit, just to try and ruin people.
