I think he'll do a few months now, deal out of jail supervised, then fuck up the deal conditions again because of his undying love of the rock and rolling the bones before he does his year or two.
That is when it will get really interesting. What wins in the end? His hatred of jail, or his love for gamba and crack?
:ross:

That's not exactly a speedy trial for that DV charge.
They put him on probation for the DV charge, with a court date at the end of the probation period. If he completed probation for that charge they would dismiss it.

Now that he violated that, he might be tried for that earlier as well.

Since the threshold for evidence admissibility in family court is much lower, is there any chance Ratdad's statement that Austin was 'trying to slap him around' could have negative repercussions for Austin? I would imagine that's why Ratdad asked the caller not to tell anybody.

Depends on if the State is willing to go to the trouble to authenticate the conversation as evidence. Ratdad could deny its actually him, in which case they could try and find the Alog and interview him.

They probably won't though. They already have enough to fuck Bossman raw dog, so why go to the trouble?

Booked on a Saturday night/Sunday morning at 3 AM, this doesn't feel like a voluntary turn in. Would something trigger such a late night pickup? If I'd hazard a guess I would say that the DV charges got escalated due to the recent 'being slapped around a bit' comment by ratdad but who knows. Might be something benign like night shift cops who have some extra time on their hands. But my gut feeling says that this late night pickup might be a foreboding clue as to his position in the legal system.
(No new charges in the system as of yet)

The record you are viewing (I've attached below as well) is for when he went into custody of the Central Virginia Regional Jail. Louisa County, where Austin is located, does not operate its own Jail, and from Austin's house to the Sherrif's HQ is about 30 minute drive. From there to the regional jail its about 45min-hour away. What I believe is the 2:54am time is when he was booked into the regional jail, and he was picked up earlier and just in a local holding cell until they had a transport to take him to the regional jail, meaning he could have been picked up at any time since we last saw him on stream.

Some regionals however will take direct lockup so its still possible he was scooped up at 1-2am. But police dont really like to door knock at that hour and it would be really curious as to why they chose for THEN to pick him up. Did a rat call it in at 1am? Would a rat call it in when he wasnt streaming?

More speculation from the main thread is Austin was selling off his Counter Strike skins, and he told one of his buyers to send $200 to his known dealer. This ammount was Austin's regular crack purchase as witnessed on many of his streams where he had to "withdraw 200 for a friend" and had obvious deliveries etc. Maybe he got another crack delivery, his dad caught him and called it in, or took Austin in on his own.

As of now I do not see any new charges.

Austin has collected three new charges including a new Domestic Violence, Obstruction of Justice, and Fleeing and Eluding.

Domestic Violence with an offense date of 10/19/2024. This is the same day that Austin disappeared and later we found out through a leaked phone call from an a-log with his father that Austin "tried to slap me around a bit"

Fleeing/Eluding the police. This is from the night he was picked up. DId he run?

Elude.png

And Obstruction/Resisting Arrest without force. So he didnt hit the cop but he actively resisted.

I'm not a lawyer but my simpleton opinion is the resisting arrest is really going to bite him in the ass. Up until this point he was largely cooperative, went to PO meetings, went to rehab, even broke down and said he was ready when he was swatted with the arrest warrant out. A judge is going to look at his record and realize that while the crimes are the same, he might be a lot harder to control and keep track of outside of prison walls since he is starting to get enough balls to run away from the law. Lock up is now starting to be the easiest option for everyone, and that is not a good sign.

He truly is a magnificent cow. A normal person who catches a charge and a few days in Jail would do everything possible to avoid going back. But not Austin. Textbook behavior. Doing the exact same retarded shit even though it wrecks their life. Every time.

Oh man he is fucking toast. He's going to do hard time for sure. At least a year since I doubt they will make him serve time for all these charges consecutively. But the two separate domestics could nab him 2 years and the other charges could tack on a third if the State is feeling petty.

They might sentence him to 1 year and let him out in 6 months though if they are still feeling charitable

I can't think of a scenario here where his judge isn't going to be absolutely fucking pissed. They have been so lenient with him every step of the way and he's fucked it up and only made it worse. Getting kicked out of rehab AND catching a domestic on the same family member that you beat up the last time you caught a domestic is not going to inspire any sort of mercy. Nothing surprises me anymore, but I'm about as certain as I can be that they are going to make an example of him.

The pattern really shows an escalation in Austin's criminality. 10 years ago it was theft. Now its hard drugs and domestic violence, and within 3 months escalated to more domestic violence and resisting. This is a progression the court cannot ignore when it comes to bond.

For the Domestic Violence, Austin was already on probation for a first time offender program, and has a probation violation hearing pending for that. Now that he's picked up a second charge it looks really grim for his chances...What we havent seen yet though is if they will then include violating a protective order as that was part of the probation ordered for the first domestic violence. "No Harassing/Violent Contact". With the new charge, that means he violated the protective order which can be its own charge...and would mean even if Austin were to be released on more probation they might not let him go back to his parents house or be in contact with Scott.

This is also a second domestic violence, Virginia moves it up to a felony on the third conviction

Yeah, the escalation is definitely going to bite him. The Judge can't have any confidence any sort of extra judicial remedies out of the criminal system will provide results. He's a repeat offender and he failed to do the steps needed to stay out of jail as ordered by the court.

I am really curious about the fleeing/Eluding. Did he get chased down on the road or was it more along the lines of his Probation officer calling him and telling him to bring his ass over to the sheriff's office to get cuffed and he didn't do it. That would qualify as Resisting Arrest and Eluding.
