Delphi murders case judge rejects request to step down

Judge Frances Gull rejected the defense teams' claims that she was biased toward the prosecution and denied any misconduct in the case.
CARROLL COUNTY, Ind. — The special judge in the Delphi murders case will not step down. Judge Frances Gull denied a second request from the defense team to recuse herself from the case.
Richard Allen is accused of murdering teenagers Liberty German and Abby Williams in February 2017 near the Monon High Bridge in Delphi.
Allen’s attorneys, Andrew Baldwin and Brad Rozzi, filed their second request to disqualify the judge on May 17.
In her response to the request for her withdrawal, Gull rejected the defense teams' claims that she was biased toward the prosecution and denied any misconduct in the case.
Gull said she did not treat either side more favorably, writing, “The Court has issued adverse rulings against the defendant, as well as against the State of Indiana. Adverse rulings do not support a reasonable basis for questioning the Court's impartiality, nor are they grounds for disqualification, they are just adverse rulings.”
In the ruling, she responded directly to many of the claims Baldwin and Rozzi made.
Gull also denied a request from the defense to remove what they called “gratuitous and demeaning commentary” from an earlier ruling.
In that April 30 order, Gull described the attorneys' work with the words “sloppiness, negligence and incompetence.”
Allen’s trial is scheduled for Oct. 15-Nov. 15 in Carroll County.

Archive link Edit for commentary- Gull has pretty clearly been biased and undeniably has risen above the perception of impropriety. Even when you are certain someone is guilty it is imperative for the courts to function without bias. This procedural fuckery is opening many avenues for appeal. Gull denying this doesn't change that and only reinforces potential future arguments.

About 15 years ago here in Portland, a kid named Kyron Horman disappeared from his school and not a trace of him or any kind of clue to his whereabouts has been uncovered in all that time. It is strongly suspected his stepmother had something to do with his disappearance, she and his father had been having marital issues but nothing was ever really pinned down on her. She moved to California a few years after Kyron disappeared and legally changed her name, which only fuels further suspicion.

I still check in on this case every now and then. Creepy how in 15 years absolutely nothing has been found that could provide closure to his dad and biological mom, it’s like he just disappeared off the face of the earth.

There are a couple retired cops I’ve spoken with in the area who have told me that “they know exactly what happened to him and who is responsible but they don’t have enough conclusive evidence to formally charge the person” take that like I did with a grain of salt but it just adds to the mystery involving what happened to this kid.

This is exactly what happened in the Doodler gay attacks case as well as the Branson Perry disappearance.

The former they know who did it but can't arrest him because men he attacked are closeted and included an entertainer and politician.

The latter they know who did it too but since Branson's remains haven't been found they can't do anything. In a sad twist Branson was the cousin of Bobbi Jo Wallace the pregnant woman murdered by Lisa Montgomery in 2004.(she killed her and ripped out the baby and stole it. Baby is fine now. Lisa was executed.)

It's a specific profile that tags the suspected incidents as being related to the supposed smiley face killers. Primarily a fairly consistent victim type, dry drowning, and events surrounding the disappearance. That's not to say I don't think it's retarded.

I do believe in a good amount of those cases there's some odd factors at play, and foul play could definitely be considered. But attempting to mystify it with a group of killers is retarded and takes away from the legitimacy of suspected foul play.

For Videos I recommend Lore Lodge. For a brief preview of how good his research is on this stuff—IIRC most, if not all of the videos he has on smiley face killers cases, he outright says that he's still not sold on the theory. He's found a lot of things that point to suspected foul play in those cases, but nothing like a stupid cult.

I think you guys are blowing this way out of proportion. Just about every place that discusses true crime has mountains of "my grandpa did it" or "my cousin was the killer." I'm short on time so the quick summary is an unidentified woman checks into a hotel, stays a few days, and then is found dead. No clothing labels or proper identification is found. The gunshot has a few problems that could be the result of a murder then crime scene cover up. So why was she killed? If it was indeed a suicide, who eats a few hours before killing themselves? Many questions surround this case that may never be solved.

This happened in 1995 before digital tracking, internet connectivity, and full scale camera surveillance.
