Pigsplaining Daily Wrap as "daily recap of what I've been doing in the last day or so".
Prestream: Reviews for the new games he is playing are good, drives and capture card discussion.
Day stream: FF7, pretty productive of a stream, HOWEVER, he is sad to report that for some odd reason which he actually knows, today everything was much slower than usual, no one is responding to him in chat. Reasons: It's Monday and it's the second day of FF7 in a row and he is a variety stream so his audience actually hates seeing the same game twice in a row. If you don't give him the buy-in, he won't be able to keep it as a daystream! *t-pose, lifts himself in the chair*
Night stream: Beat SBM2, beat each stage legitimately, no warping, yes, did use save states. 1 hour of QNA.

Overall he had a great time but the hype for FF7 might be dying :(. Here's the deal, he doesn't know if he can buy his furry game for his daystream on time. He is going to play both his new releases potentially two days in a row...but I thought that's not what your variety stream audience wants?
Jasper might be here for the cat game but the door has to be closed because Khet is home and he doesn't want to make her DEAF, but Jasper hates closed doors...you know Jasper won't be there.

The Daily Wrap: July 19, 2022 - A WIN of a Day! Two VERY Good New Releases!
Prestream: Stalling on two games, "final" lengthy discussion on if he should get a webcam or a proper camera, guess what he's getting? Lighting, greenscreen (cancelled), HINT HINT PC IS DYING. PS: He hasn't picked out a motherboard yet. Send him a website where to buy a PC.
Daystream: He tried forcing a "Jasper Reacts!" but just like his audience he quit out five minutes in. Stray looks so good his PC can't handle it, it was frequently maxing out and he got error messages that if this keeps going he is going to BSOD :stress:. It's that GRAPHICALLY INTENSIVE, IT'S THAT GOOD. IT BROKE NEW GROUND. *Insert Red Letter Media clip here*. He encountered a bug at the end where he was stuck had to reload and lost eight minutes of gameplay. You can beat the game in four hours, but it's a puzzle game and if you just play the game, maybe you will finish the game in that time, but DSP doesn't like to progress, that's not the kind of gamer he is. Allegedly gonna be 6-8h for him.
Nightstream: "As dawn falls", an artsy game where he was hyped to sell off a black kid into slavery. "Writing is actually good".

Engagement was GREAT, support was GREAT, he was talking to his wife Khet 👍 "even if one game game is good and the other sucks, at least it's 50/50 and we really need a shot in the arm, something new to do", we got TWO good games today, THAT'S COOL. And they all on subscription plans. He LITERALLY can't wait for tomorrow. So much so he still gonna stall for like two hours in the morning.
He's pumped, he's excited, he hopes you guys are too.

Prestream: New games recap, more PC talk, but a WRENCH got thrown in because Washington has power consumption laws. He doesn't understand how the government can prevent you from having a certain kind of pc for your BUSINESS.
Daystream: Six hours into Stray, not anywhere close to the end of the game. How can people say the game is only four hours long? THEY ARE LYING or BLATANTLY SKIPPING TO MAKE FUN OF THE GAME, it looks so pretty for an indie game.
Nightstream: As dusk falls. Some logic holes popped up, the game just doesn't end :stress:.

Support, viewership and engagement were a little less than yesterday. ($100 + $79 = $179)

Other less fun facts include that he places his keyboard on some shitty chair and that can he can stand for three and a half minutes while Jasper tries to slap him at every attempt of removing him.

I used to criticize him for feeling the need to tell everyone what he did during his streams. No other streamer fucking does this. But the fact he left his fucking phone on with the WWE Champions game on makes me thankful he does it. Thank you DSP.

Prestream: Mini Reviews of Stray and As Dusk Falls
Daystream: Played Fabled after a week, first video corrupted. Didn't have this issue for several weeks. Have you tried restarting your PC? Pigsplaining editing VODs with an example where you cut an apple. I don't know what produce is, do you think you know what an apple is? Youtube editing videos works totally fine now, still gotta buy a 2k PC.
Nightstream: Play Multiversus again, won a lot of matches but it's a mixed bag for his audience and the support is rough, TWO nights of this game, almost no support, only had "resonable" support ($50) is because someone gave him 34 dollars at the end. Is this because it's not SF or a walking sim? Phil never gets any support when he's smashing, err, playing Smash when he's playing multiplayer (probably a lie). He loves it's a f2p game because he can save money for WWE but he does not work for free.

Hopes FF7 gives him money again. Gonna play a racist oldschool figher or something.

Daystream: People gave him money for FF7 again, reached Disc 2.
Nightstream: Nintendo added Fighter's History (and others), which is some game that makes fun of fighters and is racist or whatever, no one asked for this, people totally had fun in the first half but then in the second half asked that pesky question of "why are you doing this?". Response: "I can't just do a random thing on my stream, I can't, if I do, I get a bunch of whiners and complainers, I can't just have fun on a nightstream. *snort* Apparently not if you get a crowd like that that just complains about everything" AND IT ACTUALLY PISSED HIM OFF because people had fun in the first half but then "the bad element comes in" and starts whining. Does he think the trolls just wait for an hour to troll? Does he think he has a part of his audience that behaves like trolls? I know this is all cope and about money, but Jesus. DSP who never can do anything random ever because MUH SCHEDULE adds some shitty random game no one cares for and then blames "the toxic element" for why he didn't get money.

No one cares about the trademark of "Level 1 Podcast", though try opening "The McDonald's" and see if the "The" makes a difference the way Phil says it does.

That's a real exaggeration: OSU's trademark means on the word "The" means they can sue for infringement if someone other than OSU uses it in a way that could reasonably be mistaken for OSU. For example the word "the" in whatever typeface OSU uses for its logo is now definitely grounds for a lawsuit, but "SUNY: The State University of New York" or "The Pennsylvania State University" would be safe because a reasonable person would realize that schools with different names, in different states are not related to OSU. It's no different when Sarah Palin trademarked her own name ~10 years ago, she got the trademark but that didn't give her the right to veto or collect royalties from news stories covering her.

But back to DSP the standard a judge or jury would have to evaluate against is whether everything taken together (content of the podcast, branding, aesthetics where it is available, target/real audience, and so on) shows that there is at least a real potential for confusion between the real "Level 1 Podcast" and Phil's prestreams. Obviously proof that people have gotten the two confused is stronger proof. All those other factors will matter more than the inclusion or omission of the word "the". I'm a lawsperg, not an attorney, but the real Level 1 Podcast's decision to rebrand as "Diceology" 2 and a half years ago seems like it would really help Phil - there was a 2 and a half year grace period where nobody was using that name so the scenarios where someone would have listened to "Level 1 Podcast" routinely, not realize they rebranded, then stumbled across Phil's prestreams thinking the old podcast was back seem very contrived.

The funny thing is when Phil created KOGaming he made sure that KOGaming wasn't trademarked or used in any other way. Guess he simply gotten lazier or just wanted to use the Keem insult as a way to stick it to him

 
Prestream: History segment about how he drank and dodged work to play a Batman game in 2009 so he could farm day one views.
Daystream: Batman Arkham Asylum runs pretty well but not 60fps, whoever told him that it runs fine on PS5 so Dave could save eight dollars is an epic troll tbh. "25-30 frames...of animation", was handheld. "Meaningful playthrough" because he only played it twice in 13 years and Derich was like 5 when it came out. Good support of $80.
Nightstream: One hour left in Fable, not gonna spoil but there's a twist boss fight (well thanks), Halo comparison. Does not want to do the DLC. Can't believe he himself rated it the best of the series in 2014. Phil who looks up every game in advance did not know he only had an hour left so he put up a retard poll where half the options are invalid now, good job.

Gonna shop scroll for another night stream.

Prestream: It was a hot day, he discussed various topics, watch the thing...Real talk, it was insanity, atleast skim the main thread.
Daystream: Ginbrain doesn't remember Disc 2 of FF7, great time ALTHOUGH slowest FF7 stream so far and it's disheartening because his previous streams were slow too. I TOLD YOU WHEN I LEFT TWITCH THAT I NEEDED TO MAKE UP THE MONEY. I was consistently around 800 subs a month. :story:
Nightstream: Fighting game collection, he wore a new shirt since 1992. It's been a month and netcode is not wholesome anymore because all the scrubs left and all the tryhards are lagswitching. Netcode is just AI that rolls the dice depending on the matchup. "'Aww, you don't know what you are talking about' you guys are fucking idiots. I don't care what the rest of the fighting community says, just look at the video". 30th anniversary edition cancelled FOREVER. WAY more support here than the FF stream (by 7 bucks). He says he was a fighting game pro, and won't hesitate to tell you he got 4th at EVO one year. The fact that he's calling out "tryhards" in the goddamned video title because he refuses to believe that he's not actually any good at fighting games these days is just amazing. Everybody online is simultaneously a tryhard and a scrub who abuses lag, somehow. And then he spent even more time complaining about rollback netcode because he didn't do enough complaining in the stream itself. Swears it's a conspiracy the entire FGC is in on to say rollback netcode is good, but only he knows the truth. Sure, Grandpa....
