I am really conflicted here.. He is merely speaking, speech.. On the other.. He makes a habit of walking up to people and ever so slightly short of spitting in their face. Really close to fighting words. (Hyper oversensitivity and fragility over a simple word aside) Utterance of "nigger" alone of course, even face to face, falls short in most cases of "fighting words" but... I would argue that specifically calling someone it to their face, unprovoked and aggressively, gets a lot closer than i would like. That he seems to have a history of fantasizing over the idea of running into the "wrong person", all so he can "legally" shoot them. Makes me very unsympathetic to his claims of mere speech.
There is a vary fine line to exceptions like "fighting words" or any other 1st exception. I believe any justifiable "exception" be a case where it goes beyond mere speech. Where the punishment is not from the speech, but the clear, unambiguous and imminent outcome of specific speech. Like yelling "kill him" in front of an angry mob holding a victim, esp from a leadership role etc.
I will say, that it took him this long to get attacked, makes him and his whole reason for doing it look real fucking retarded. It took running into an unstable former violent criminal to find someone stupid enough to take his bait.
The fact that his whole deal can best be summed up as "bait" in the first place is the most damning part of his claims. Don't know how self defense laws work in the state but.. I imagine it will be hard to find 12 people who will look past his stated intent/fantasies and view it is defense. Even if it is in the strictest sense. Even assuming they can. A lot of laws make exceptions to the person who starts the fight in pretty physical/verbal vague terms. Another issue is how the laws deal with seeming intent to hopefully find someone who will react. That fact alone may negate self defense claims legally speaking. That's at the very least awareness, if not intent to start a fight.
Personally i say he's fucked without some really explicit proof. Like getting hit from behind walking away or something, leading to a sustained assault. Still uphill for him. His posting history, detailing his wishes for just this outcome, certainly won't help. Still i'm not sure that what he did alone should count against self defense claims. It alone doesn't logically warrant assault, even if that part isn't hard to imagine.
