So some interesting new lore coming out of the Olive Garden redux video with the introduction of a previously never heard of figure named Robin, who FlexBerger is now saying was behind the Olive Garden incident not Clark like we've always been told was behind it.

In particular, Flexberger implies a full on retconning of the lore of Larsen, implying that Robin was behind almost of the really bad shit not Clark, who Flexberger claims was more interested in coddling Daniel and not really trolling him maliciously.

The video also does it's best to white knight defend Daniel in the video as a victim until the very end where they throw in a half assed condemnation as thought they realized last minute they had to do so or be subject to backlash for defending the fucker.

I've noticed similar shit in the previous larsonleak video "The Daniel Larson Oakland Incident", this nigger is rewriting the lore for some reason and it's not convincing.

Regardless, he is a faggot and these recent "documentaries" are unwatchable.
 
New filing in the docket that summarizes the road so far and shows what's to come next year. As we already knew, Danderson's lawyer requested a psych eval in September to prove that he was sane enough to be let out of MAXIMUM SECURITY INSANITY PRISON. The results of this evaluation were submitted to the court in early November.

If I'm reading this correctly, the court has yet to look at this report, and has only seen the BOP's own eval so far. Presumably to address this, Dan's lawyer has asked for an evidentiary hearing on Dan's "restorability and continued detention", which was originally set for January 9th.

In this filing, Dan's lawyer is asking for this hearing to be moved later into January due to scheduling conflicts.

The language of "restorability and continued detention" is making me wonder what Dan's lawyer is gunning for here. If the court finds that Dan isn't actually insane, he would just get kicked back to a regular federal prison, right?

Not really. For instance, it took Utah seven years to find Brian David Mitchell (the kidnapper of Elizabeth Smart) competent to stand trial, even though imo his pretense of insanity was absolutely and obviously utterly bogus.

Depends on if the goal is "you have to stand trial no matter what and being found insane is just a temporary bump in the row and you get stuck in limbo hell indefinitely until we find you sane enough to be found guilty". Some places don't accept being insane as a catch all excuse for doing evil, which is why in spite of media portrayals, being found insane isn't the end of the legal mess.

I think as far as I'm concerned we have enough gold, the brightest flame burns for only half as long kinda thing. This is a problem with most cows as well but most of danny's content is not organized or likely just disappeared at this point.

it would probably be extremely funny if we had more Daniel content, but at this point we all know the best place for him is anywhere but the public. I'd also be afraid that a Daniel turned out on the streets again would be horrorcow more than anything, and we'd end up with Daniel going off the deep end and doing something really screwed up. The "BOMB YOU!" video I feel like shows that we were going that direction anyways, even if Daniel had no intention or way to pull off such a thing.

Can somebody elaborate on what exactly a restorability hearing entails? I know it involves some questioning of the person at hand, and looking at his behavior, but what sorts of questions are asked and who else is present at these hearings?

IIRC, in states where being declared criminally insane simply means you are warehoused until you are declared sane and then put on trial, it's where everyone gets together to get a progress report on how "project make Daniel sane enough to stand trial" happens. If they haven't made Daniel sane enough for trial and if he's proven himself violent enough to staff at his current location, they might decide to move him into a higher security facility and try again there to make him sane and/or warehouse him were he can't hurt anyone.

I don't think they'll be asking Dan any sanity-related questions, the judge will probably just hear from various defense and government witnesses about why he isn't/is restorable.
Regarding restorability, I kinda misinterpreted what was going on here: Dan's lawyer is arguing that he isn't restorable. while the government keeps trying to kick the can down the road by extending his "restoration proceedings" in hopes that he'll become sane enough for a trial.

They're doing this because (according to ChatGPT) if he is found not restorable, the state would eventually have to stay or even dismiss the charges, since they can't just keep someone in jail indefinitely just because they're insane.

What Dan underwent was a restoration attempt under U.S. Code § 4241 (d), which states that the AG has four months or "a reasonable period of time" to determine whether Dan's head can ever be unfucked. If he's found not restorable, at the hearing on the 22nd or after yet another round of evaluations, the court would then have to determine whether Dan's release would create "a substantial risk of bodily injury to another person or serious damage to property of another".

If it would, the Attorney general would be given the responsibility of releasing him into the custody of the state he was originally tried in, which in Dan's case would be Colorado. Colorado would then have to take responsibility for his continued detention and treatment (U.S. Code § 4246 (d))

If it wouldn't create such a risk, the court could either order him to be released immediately, or order his conditional release contingent on him following a treatment and care regimen that would keep him from being a "substantial risk" towards others or their property. (U.S. Code § 4246 (e))

So, does Dan pose a substantial risk of bodily injury to another person or serious damage to property of another? I don't think he's ever caused serious property damage before, and it's not like he would ever be able to actually BOMB EVERY FUCKING POLICE STATION IN THE COUNTRY, but he's proven that he's capable of hurting people (Fuckass Bob primarily) if he feels like he can get away with it.

I think the very best case scenario for Dan is conditional release, assuming they were able to find a treatment regimen that keeps him somewhat stable during his stay at MCFP Springield.
But the feds will probably just dump him into a Colorado maximum security insanity prison under 4246 (d) and be done with it.
