Do twitter users own their avatars

So you have a twitter user and they have a custom avatar on their account. Is it fareuse to appropriate that likeness if it's being displaced in public?

Then after the likeness has been appropriated and the twitter user latter tries to get trademark on their avatar, can the use of their likeness invalidate their trademark request?

Asking for a game developer.

I don't think so no but relocating the image is considered transformative especially for the use of criticism and ridicule, therefore it's fairly safe even if the retard in question is especially litigious.
