It helped for Sargon that his use wasn't just clearly fair use but "get the fuck out of here" fair use enough to be sanctionable.
She was clearly stupid to file the lawsuit in the first place when Sargon's video was clearly transformative in that it took multiple smaller clips of the original and cut them together in a new way as to provide political commentary / critique. That aside, Akilah didn't help her case at all by making several very public statements about using the lawsuit as a way to hurt Sargon financially. If she would have shut the hell up the judge likely would have not awarded Sargon lawyers fees at all or perhaps only a small percentage of them.
Out of curiosity I check in on her YouTube channel which she recently tried to start posting videos to again. She still has over 100k subscribers, but most of her videos in the past year don't even make 1k views, which makes her base even more dead than Jim Sterling's. She also has a video from a month ago about moving back to New York because she's apparently too much of a failure to make it in LA. She has a BlueSky with a little over a thousand followers, but no traction on her tweets (or whatever the fuck they call them there) and only one speaking engagement (at a small university of fewer than 1,000 students in Kentucky) later this year.
I'd like it very much if Denims, Frogan, and Kaceytron all became similarly irrelevant.
