Flashgitz Appreciation Thread - Two retards animating retards for retards

  • Happy Easter!
I don't know the context of how it was used, but indeed parody can be an exception to trademark infringement (though not in cases where logos are copied or nearly copied in order to cause brand confusion). Jack Daniel's Props. v. VIP Prods., 143 S. Ct. 1578, 216 L. Ed. 2d 161 (2023) deals with the standards used in determination, exceptions, and so on.
Still, it's questionable if the characters of Bluey, Bandit and so on are actually "trademarks". The VIP products case hinged on the fact that while it was a parody, it was so similar of the brand identifier as to be indistinguishable. The issue the court had with it was that if they sided with the Parody, then it would be possible for someone to make a Soda branded "Coca-Colo" in the same font, color and lettering as the "Coca-Cola" symbol on actual coke cans.

In this case, there really is no way anyone could be confused as to whether or not this is an actual Bluey episode, let alone affiliated with the companies behind it. More importantly flashgitz didnt really use corporate trade names and brand markers as the principle selling point of their product. Which was the big issue in the Jack Daniels case where the parody rather blatantly used a corporate branding as its hook. It is much more appropriate in this case imo the raise a copyright issue where the copyrighted material is being missused, rather then a trademark complaint.

Its also important to note that a reason they probably went the Trademark route is that Youtube automatically deletes when served with a Trademark complaint with no appeal. Had Ludo filed a DMCA instead, Flashgitz would have had an opportunity to respond. A DMCA is also a legal instrument that commits Ludo to certain obligations. Complaining about a Trademark violation instead removes that issue entirely for them as youtube's policy with removing Trademark infringing material is Guilty until proven you are still Guilty. Ludo also does not have to assume any liabilities that the DMCA imposes, as the action is solely at Youtube's discretion.

Lol. LMAO even to anyone who thinks this.
Most corporations use the Copyright bludgeon. Using Trademark complaints on Youtube is a bit more involved, and usually not resorted too. Especially at a video with hundreds of thousands of views. But I do agree, I should have said "one of", as it's certainly not the only one

Thank you, for this lesson.

I genuinely loathe the Bluey fanbase. The fact a show for pre-schoolers- LITERALY PRE-SCHOOLERS- has this obnoxious cult of (suspiciously childless) freaks worshiping it and having an absolute shitfit whenever anyone makes fun of or criticizes their sacred cow dog boggles the mind. It's not even like the artstyle is all that good, they look like AI generated Brian Griffin offspring.

Total Bligger Death.

Kids could would and do daily. They are raised on the tablet these days and even if they aren't for most of em on youtube for the majority of the shit they watch. And most of em watching "YouTube poops" and or parodies. So much so they've kinda replaced the vanilla versions. Obviously the netflixs and maxs and whatever the fucks of the world are still used. Yet a good chunk of kids these days consume media not unlike the bluey parody in the op. It's all so much more fucked than the ytp we grew up on though. Not condoning copyright faggotry or furries or nothing. But if the shoe was on the other foot and this was the folks behind bluey slapping down some weirdo furry parody shit most here would be stoked and heckin protect the kids pilled despite whatever systems where abused to do so. It's kinda fucked actually to think about. We moving toward a future where harmless parody and fair use and shit is actually just gonna end up producing a generation of degenerates after degenerates because of how children are consuming media. It's a very slippery slope. We a generation of children growing up functionally retarded away from them just redefining fair use or getting rid of it entirely. As crazy and outlandish as that sounds I think some here may underestimate just how negatively determential some of this shit has become for the mental health and growing conditions of young children. Obviously parents gotta do better but I feel like there's a bigger conversation to be had here than just fuck furries. At some point if you wanna protect children your gonna have to put up with these franchises abusing trademark and copyright. Somethings going to have to give at some point.

I don't think the studio did it out of any actual trademark or copyright issue but rather they did it to hide the fact that their most notorious and vocal fans are pedophilic furries.
Furries coping and seething because they know the video is spot on about how their community acts.
These 2 comments hit the nail very hard in the head. The parody is a direct orbital strike to every furry that jacks off to Blueu saying "you, yes you, you are disgusting filth and ahould be ashamed of yourself" and ending up with a smile emoji.

Love that shit, and thankfully furries are not a protected class like trannies, I can only shudder at thinking of a world were furries were the golden calfs...

These guys are what johnnyutah could've been if he hadn't cucked out like so many other millennials did.
I don't like Hunter cause he is an attention seeking corporate fag.
I hate that he's not doing animation anymore and going for the easy money of streaming/commentary videos.
I found out by complete happenstance (i.e., YouTube ads while in the bathroom) that a clip from one of their videos is being used as official advertising for Honkai Starrail.
And you didn't screen it?
