COCOA – Police and prosecutors say little can be done legally after the revelation that a group of teens filmed the dying moments of a 32-year-old disabled man last week, with the teens mocking, cursing and laughing while the man drowned in a fenced-off pond.

Anyway as callous as this is it's not like they could do anything. Calling 911 wouldn't really come in time and I assume they don't have lifeguards on call. Going to try and help him, he'd probably just drown you.

Judging by the voices of the teens, it sounds like a demographic that doesn't know how to swim. No on is obligated to save someone from drowning unless they're on duty and it's their job. As someone who's trained in rescue swimming and has saved people from drowning which includes coming up behind them and choking them into submission, I highly recommend you not attempt it because the likelihood of you getting yourself killed is pretty high.

Some jurisdictions do you require you take action even if that action is to notify the authorities. Some jurisdictions require you to interfere directly if necessary- this is an extension of Good Samaritan Laws called "Duty to Rescue" and can be evaluated on a case by case basis. What do you want from me, lol? Obligations to rescue have existed and continue to exist, albeit they are rare in the English speaking world with a few notable exceptions. Civil law countries like France are the most common, and whether or not the requirement that you not "needlessly risk your own life" is honored can vary greatly.

In addition, Florida is a state that requires notification of authorities, regardless of probability of successful rescue.

"In the United States, as of 2009 ten states had laws on the books requiring that people at least notify law enforcement of and/or seek aid for strangers in peril under certain conditions: California,[10][11] Florida,[10][12][13] Hawaii,[10][14]Massachusetts,[10][15] Minnesota,[10][16] Ohio,[10][17] Rhode Island,[10][18] Vermont,[10][19] Washington,[10][20][21] and Wisconsin.[10][22] These laws are also referred to as Good Samaritan laws, despite their difference from laws of the same name that protect individuals who try to help another person.[1] These laws are rarely applied, and are generally ignored by citizens and lawmakers.[1]"

I'm not sure what any of this has to do with whether or not I am personally capable of rescuing a 300 lbs black man, but in Florida that they had the legal duty to seek assistance. They are unlikely to be penalized, but still. It is worth nothing that this is one of the cases in which it is possible, however.

While a lot can be said about the character of a person who chooses to film and openly mock someone as they drown is another discussion entirely. Considering it only takes a few minutes to happen, it's improbable EMS would have reached the man in time anyway. Prosecuting the kids would be a waste of state resources and probably thrown out when compared to response times and if not then why wouldn't his family be able to sue for them not showing up in under three minutes if called? I also do not give a shit whatever the French standard is as it will never be applicable to this.

ETA: just watched the video on YouTube where I can see a time stamp and the death occurs a little over a minute in. Prosecuting these kids for an impossibility of rescue would be insane. I wish their mothers raised them to have compassion but am glad they all had sense enough to not kill themselves getting in the water.

Just pointing out I woulda probably called for help instead of standing there mocking a drowning guy. I don't care how exceptional he was or pointless it may have been, my first gut reaction would be trying to help in some way and probably feel like shit if I couldn't. Drowning people are a) too fucking dumb to swim and b) have an unfortunate habit of drowning those attempting to rescue them.

People who have no expertise in rescuing drowning people should not endanger themselves attempting to rescue these evolutionary failures who can't do what a newborn puppy can do.

Just to clarify further, the reason it's so dangerous is because drowning is like popping a boner when you are ten, you have no control over your body. If they get their hands on you they will push you down to get up to the surface.
