I'd laugh if despite the bankruptcy claim, they still had to pay. Because karma rightfully deserves to bite them harder on the ass.
A couple here said that the lawsuits probably won't discharge in bankruptcy.

While Gawker white knights see this as "death of free press", others such as kiwi's see this as the death of a gossip rag and the raging salt tears of its white knights.

Way to whitewash the issue while simultaneously making Gawker look like the blameless victim. Gawker leaked Hogan's sex tape; he asked them to take it down numerous times before finally threatening to take legal action, eventually getting a judge to file a cease-and-desist; Gawker actually wrote an article gloating about how they wouldn't take the video down; Hogan finally took the case to court where Gawker got roasted.

All of Gawker's white knights keep trying to portray this as a First Amendment issue, but this entire thing would have never happened if Gawker had simply taken the video down. They chose an incredibly stupid hill to die on. It was never a freedom of the press issue, because no one besides brainless gossip rag readers cares if you're allowed to publish celebrity sex tapes.

Willful torts are not generally dischargeable.

Telling a judge to go fuck himself when he slaps you with a court order is just plain ignorant, though. And will get you fucked, hard.
 
It's interesting that they have an offer from Ziff Davis. That's the company that owns IGN. No doubt with the intent of salvaging the sites that aren't a noxious liability and burning the rest.

Edit: In fact their statement specifically expresses interest in every Gawker Media site except Gawker.

I'm sorry to have let you down. I don't love every story our sites have published, but I'm proud of plenty. I've worked at numerous media outlets that have run great stories and bad ones. That's how it is. The existence of a bad piece or an unpopular one or a controversial one or even one a jury doesn't approve of doesn't, in my mind, warrant the attempted destruction of a media outlet. I run Kotaku with an open ear to feedback. I listen to criticism, do my best to respond to it and try to improve the site in the process. Always have, always will. The Thiel stuff, though, is unusual. Without his maneuvering, we wouldn't be in this position.
