You know, I used to say America sucks ass but seeing this type shit makes me happy I live here. Sure, social media censors the hell out of you and promotes misinfo but at least it doesn't lead to an arrest. I don't really use gamer words but I assume the end game to this is just being on a site with them on it will be reason enough for an arrest in the future. Null called this early and now it's happening to random nobodies as well.

Does anybody speak German? I have a hunch the law that allows this is intentionally vague and if it is, it will definitely be abused later on. I could google translate it, but the wording is really important and machine learning translators are terrible for that. Does it have a specific criteria for what is "hate speech"?

There's a bit of a misconception here.

We don't have one single specific law that says "Don't say niggerfaggot on Twitter, it's hate speech and thus verboten". They are "just" starting to enforce common other laws now.

The most prominet would be § 130 StGB "Volksverhetzung".

(1) Whoever, in a manner likely to disturb the public peace,

1. incites hatred, violence or arbitrary action against a national, racial, religious or ethnic group, against parts of the population or against an individual on account of his membership of the aforementioned group or part of the population, or

2. attacks the human dignity of others by insulting, maliciously disparaging or defaming a aforementioned group, parts of the population or an individual because of his membership in aforementioned group or part of the population,

shall be punished by imprisonment for a term of three months to five years.
(2) A custodial sentence not exceeding three years or a monetary penalty shall be imposed on anyone who

1. distributes or makes available to the public any content (Section 11(3)) or offers, provides or makes available to a person under the age of eighteen any content (Section 11(3)) which
a) incites hatred against a group referred to in paragraph 1 number 1, against parts of the population or against an individual because of his or her membership of a group referred to in paragraph 1 number 1 or of a part of the population,
(b) incites acts of violence or arbitrariness against persons or groups of persons referred to in subparagraph (a); or
(c) attacks the human dignity of persons or groups of persons referred to in subparagraph (a) by insulting, maliciously disparaging or defaming them; or

2. produces, obtains, supplies, keeps in stock, offers, advertises or undertakes to import or export any content referred to in number 1 letters a to c in order to use it in the sense of number 1 or to enable another person to make such use of it.

(3) Any person who, in public or at a meeting, approves of, denies or plays down an act of the kind described in Section 6 (1) of the International Criminal Code committed under the rule of National Socialism in a manner likely to disturb the public peace shall be punished by imprisonment not exceeding five years or a fine.
(4) Anyone who publicly or in a meeting disturbs the public peace in a manner that violates the dignity of the victims by approving, glorifying or justifying the National Socialist reign of violence and arbitrariness shall be punished with imprisonment of up to three years or a fine.
(5) Subsection (2) shall also apply to any content referred to in subsections (3) or (4) (Section 11(3)).

Something like "All faggots should die" could fall under § 130. "All Juden need to be gased" is easily an 130er offense.

Then there is law § 185 StGB "Beleidigung" ("Insulting").

Insult shall be punishable by imprisonment for a term not exceeding one year or by a fine and, if the insult is committed in public, at a meeting, by disseminating a content (Section 11(3)) or by means of an assault, by imprisonment for a term not exceeding two years or by a fine.

Calling someone "asshole" falls under this law.

Calling someone "Jew" will trigger § 130 instead of § 185.
Calling someone a "faggot" could be a §185 or if the state attorny wants to fuck you over a §130 offense.

But there are some more laws, targeting more specific cases. Technically you can get into trouble for insulting a dead person bc even the dead have some sort of honor. Like saying something like "[dead politician X] was a complete piece of shit and I am glad that he is dead" can lead to a trial*.
Or we have a specific law that punishes insulting our Bundespräsident. The Bundespräsident is the highest political person although he is now only for representation.

Usually the cops use the two above mentioned laws to go after persons who say mean words in the internet.





*Saying "Hitler was a piece of shit and I am glad he is dead" won't get you into trouble bc obviously fuck Hitler bc he was bad and it's ok to insult bad persons. Well, I am a bit sarcastic here but to be serious it's very unlikely that you will get into legal trouble for shittalking Hitler. Technically it could but practically it shouldn't.

I'm kind of interested in knowing about how much of this is the fault of West vs East German (manufactured) culture. I'd also be interesting in knowing the breakdown in public support for this sort of thing between East and West Germoids, though given that the distinction disappeared more than 30 years ago, I expect it to be a little nebulous.

In reality it's a bit more complexe than what I tried to explain. A lot of also depends on the specific case. Also I'm not a lawyer.

To begin with one need to know how a investigation starts:

Example 1: Your mother has a Twitter account. I tweet "You dumbfucking crazy ass bitch crack whore" at her, right beneath a cute pic of her cat she posted.
That could easily be seen as insulting her. But for me getting into legal issues she would have to make the report to the police and file a case against me. The cops can't just browse my Twitter account, see the tweet and say "Oh wow, that's mean. We should get this motherfucker."

Example 2: If I would call here a "dumbfucking Jew whore that should be gased like the rest of here rootless clique of shady merchants" the case is different bc calling here a "Jew that should be gased ..." would trigger § 130 and that § works a bit different. The cops are not only allowed but also forced to go after everything that falls under § 130. So if a random cop would browse my Twitter account and see that mean tweet he would have to file a report himself and the cops would have to start an investigation without your mother doing anything.

Let's move on about insulting dead people:

1.) Your mother is dead. I say on Twitter that she was an "ugly dogfaced cocksucking piece of trash". Only a living relative could get me into trouble here bc he would have to a file a report. Like you as her son would have to file a report.

2.) Your mother is dead and was a person of interest, some sort of a public figure. Like a very well known actress who got a couple of prizes like 1 zillion oscars and whatnot and she was beloved by the majority of people. In that case everybody could file a report bc my comment could be seen as disturbing public peace and being made to stir public unrest.

So now for your example:

To be morally bankrupt is more of a judgement that could be based on facts. Facts = things Romans did and we know about it bc of historic reports or books like Casear's memoirs. Things they did that are deemed to be immoral after todays standards.
Like, idk, slavery. Slavery = bad. Or like they did war. War = bad. Or they ate their first born childs. Eating your child = bad. 3 bad things the Romans did -> not very morally people -> my personal judgement/opinion

Also you would have to need someone to file a report on you for this statement. And who should this be? There are in the strict legal sense no relatives left who could go after you. Like no Italian citizien could argue "Yeah, but the ancient Romans where my ancestors! My fee fees hurt!" bc that's not how being a relative works in a legal sense.
Maybe a random person could bc that random person thinks your statement would harsh enough to disrupt public peace. But I honestly doubt this. It doesn't sound like a statement a lot of people would give a shit about.

Also there is another aspect: Although everyone can file a report against everbody for something someone said it's up to the cops and to a states attorny for a case becoming an actual trial. Our whole justice system drowns in work. Too many cases, not enough cops for investigations, not enough judges and states attornies, not enough time. The whole covid arc made everything worse bc we had 2 years where everything got slowed down massively.

Question on enforcement: what languages will “hate speech” qualify in? I have a feeling English, German, Polish, and Russian will all be sought after but if someone in Arabic talks about how all the whores showing their bodies off in public is an offense to Allah and they should be executed that suddenly that won’t be worthy of investigation.
