Chris could've just been saying that as a cope. Like when he claimed a few months back to be going back home... only to wind up being sent to the mental hospital.Last month he was hell bent that he was getting out soon "on good terms". However a month later, it's cleared to go in front of a grand jury. I have no doubt that there was a deal in place, and he either fucked it up, or some new corpse floated to the surface at the last minute.

The deciding point here is how badly does the dementia have to be to constitute as sufficient mental impairment that one loses the ability to consent, and if Barb meets that criteria. Chris could probably argue that Barb was assessed to be well enough to live on her own and even drive, which suggests that she might not be impaired enough to be unable to consent. Even if they prove that Barb has dementia, it's not going to be as easy to prove rape as many assume.

Heilberg actually seems to be a well respected lawyer with previous high profile cases, so I believe he's capable of arranging such a deal. However, the key part is if he gives enough of a fuck about Chris to make the effort to do so. I doubt Chris can pay him, and this is not the kind of case that will bring him mainstream recognition. Also, Chris is very annoying to deal with. Heilberg might simply want to get this over with as quickly as possible, and I don't blame him.It’s been speculated that there is possibly a deal in the works where Chris pleads to a felony count in exchange for a few years prison sentence, suspended after a year of time served, probation, and RSO. If Chris violates Probation or RSO, he goes back in to serve the rest of his time. Heilberg might have drug things out or insisted that things be drug out for a year in order to keep Chris in County Jail/Western State racking up that year’s time where it’s a lot safer and easier than State Prison. If this theory is correct, we’ll see Chris’ case head quickly from the Grand Jury to a Plea hearing and a sentencing.

Sex offenders of any type are prohibited from schools, parks attached to schools, etc. Furthermore, there's very little difference between the tiers in terms of restrictions other than higher tiers have some added penalties for entering a school or school bus, and not being able to work as a taxi driver.
The main difference between the tiers is how often you have to report and how long you have to.
Fortunately for Chris, the distances from stuff he's prohibited from are not very large, and the kinds of places are fairly limited. Virginia is not very harsh compared to some other states (like Florida).
Chris is currently potentially facing no SOR status (incest with a non-incapacitated Barb), tier 1 (for incest if Barb was incapacitated), or tier 3 (rape). We'll know for sure after it's received by the grand jury and the public record of his charges is made available.

Even if Chris were to miraculously worm his way out of this, his tugboat will be gone, his house likely will be condemned or foreclosed in under a year, and he’ll still be completely unemployable. In short, he’s completely fucked, and it’s best that he’s put in a psych ward. Worst case scenario for prison: he’s put in genpop and will be killed within a few months or weeks. Even his best case scenario just has him being delusional in psych ward (which will get worse when barb kicks the bucket)
