I keep seeing this "IF he gets out"
I'm confused..hasn't he been in jail for a year? And even if they convict him I was under the impression he there's a max sentence for this of only around a year right? Won't they HAVE to let him go even if he's found guilty on account of time served? Or am I just wildly misinformed?

Chris is more than likely getting out, just maybe not today. But if anyone could fuck up a foot from the finish line, it would be Chris.

I have a very hard time featuring the notion that Barb has been home alone for a year without someone there every day to supervise her. Plus, haven't quite a few people gone by the house and reported it's virtually cleaned out with only one light on somewhere inside? I think Chris is hearing things second-hand and twisting that information around so it fits with the outcome he wants to happen and has written in the script in his head.

And there's no way they're going to allow Chris take over ownership of the house. His name isn't on the title. Any idea what that additional charge might be? I can think of a few things that could be laid on him in circuit court, but nothing that J&DR could throw at him. I'm not saying there isn't anything, just that I can't think of it. The prosecution might try to charge him with multiple counts of incest, but that would be stretching IMO. It's a lot easier to prove that incest has occurred than to prove individual, specific acts of incest.

The one thing that seems to extend their jurisdiction (at least to issue injunctions) seems to be if the charge involves "family abuse."

"The protective order may be issued for a specified period of time up to a maximum of two years. The protective order shall expire at 11:59 p.m. on the last day specified or at 11:59 p.m. on the last day of the two-year period if no date is specified. Prior to the expiration of the protective order, a petitioner may file a written motion requesting a hearing to extend the order. Proceedings to extend a protective order shall be given precedence on the docket of the court. If the petitioner was a family or household member of the respondent at the time the initial protective order was issued, the court may extend the protective order for a period not longer than two years to protect the health and safety of the petitioner or persons who are family or household members of the petitioner at the time the request for an extension is made. The extension of the protective order shall expire at 11:59 p.m. on the last day specified or at 11:59 p.m. on the last day of the two-year period if no date is specified. Nothing herein shall limit the number of extensions that may be requested or issued."

Note, this is from the specific section of the law relating to the J&DR court, which is a court of limited jurisdiction, and the limits are that it can only do what it is specifically authorized to do by statute. This particular statute says two years.
