Police haven't released many details about the threat but say they're collecting evidence and conducting interviews.

Anyone who has recently talked to Sawyer is asked to call police.

He is being held without bail.

RUTLAND, Vt. (WCAX) "By the grace of God and the bravery of a courageous young woman did we avert disaster," said Gov. Phil Scott, talking about a foiled plot to shoot up Fair Haven Union High School.

Police say the plot was concocted by Jack Sawyer, 18, of Poultney. Sawyer appeared in court Friday to face charges of aggravated attempted murder, attempted first-degree murder and attempted aggravated assault with a deadly weapon.

The murderous plot took days to unravel. But most importantly, there was no attack and no one was hurt.

So what exactly lead police to Sawyer? It was thanks to a few concerned citizens who came forward to police. And police say it's lucky they did because they say Sawyer had already put together what he called "The Journal of an Active Shooter." In it, were lists of weapons he intended to buy, plans for how to carry out the shooting and a list of current and former students who he wanted to die.

Sawyer walked into Rutland court in camo and handcuffs Friday afternoon, charged with plotting to carry out a mass shooting at his former high school.

"There's been 18 school shootings since January 1. And you always think in my career like, this is Fair Haven. It's not going to happen here," Fair Haven Police Chief Bill Humphries said.

Humphries said they were first alerted to the threat Wednesday. Someone told police that Monday, they heard Sawyer was acting strangely and had made threats against Fair Haven Union High School. Then, they were told Sawyer had bought a shotgun at Dick's Sporting Goods in Rutland, along with ammo. But when police spoke to him on Wednesday, he told them it was for target practice and he said he hadn't made any threats against the school in the past two years.

"We had found no probable cause to make an arrest," Humphries said.

But that changed the next day when a juvenile from New York alerted police to disturbing text messages from Sawyer, reading in part, "Just a few days ago I was still plotting on shooting up my old high school..." And then, in response to the school shooting in Florida: "That's fantastic. I 100% support it... I think the human population sucks so I like to hear about cases of natural selection... It's just natural selection taken up a notch."

"This is a classic example of the person who came forward, from out of state, is the true hero out of this because they put aside everything else to say, 'I think there's a problem.' And based on that, it allowed law enforcement to intervene and avert a potential disaster," Humphries said.

During an interview with police, Sawyer allegedly confessed to his plot.

"He told detectives that he was planning from a couple of years ago to shoot up Fair Haven High School," said Maj. Glenn Hall of the Vermont State Police.

Sawyer told investigators he'd gone to the high school for his freshman and part of his sophomore year before running away and eventually being sent away for mental health treatment in Maine.

He also allegedly told police he was obsessed with the Columbine High School shootings and had researched them extensively. And police say he told them he bought the shotgun recently, as part of his plot to shoot up Fair Haven High School. Sawyer allegedly told police he planned to take out the school resource officer first and then use an AR-15 and other guns to kill as many students as he could before taking his own life. And he allegedly told police he wasn't sure when he was going to carry out the plan but he would no matter what.

RUTLAND, Vt. (WCAX) New clues about the case against Jack Sawyer. Sawyer is the teen who allegedly plotted to go on a shooting spree at Fair Haven Union High School. Tuesday in court, we got a look at the evidence prosecutors will use against the teen. We heard from witnesses for more than two hours and testimony still wasn't done when this story was published. Most of them have been police officers, but we also heard from the acting principal of the high school. All of them giving a clearer picture of why prosecutors believed Sawyer posed a real threat.

Sawyer, 18, walked into Rutland court on Tuesday in handcuffs. His defense attorney asking a judge if they could be removed. They weren't.
First on the stand was the acting principal of Fair Haven Union High School, Jason Rasco.
"There were a number of red flags," Rasco said.
From him, we learned that Sawyer had raised red flags at the school in March 2016 while researching a report on Columbine. The principal said teachers and students reported they were concerned. He said Sawyer had also started writing on social media under the name of one of the Columbine shooters. He said he had conversations with Sawyer and based on those, the school began a threat assessment of Sawyer.
The school resource officer testified that he believed Sawyer had both the means and motivation to be a threat. At that point, Sawyer ran away to California and was later sent by his parents to the Brattleboro Retreat, and then to a treatment school in Maine. So he never returned to the school. He said earlier this month, 38 students called out because of Sawyer being back in town.
We also heard several video clips from Sawyer's five-hour interview with police. In one clip, he admits to police that he was still angry with the school. In another, they discussed alleged Facebook messages between Sawyer and a friend in which he called the Florida school shooting awesome. And in a third clip, he discusses with police the different guns he would use to carry out his plan.
There is still more evidence testimony scheduled for this week. That has tentatively been scheduled for Friday morning. In the meantime, Sawyer is being held without bail while it is determined whether he should be held behind bars while he awaits trial.

It seems to me like he got cucked harder with his plans than @FuckYou.

Glad to see police actually doing their job on a regular basis - I'm being serious.
I'm sick and tired of all these school shootings and am happy to see someone actually stop one for once.

Still doesn't fix our gun control issues here in the US (that's a battle we have yet to win), but this is still a good day, IMHO.

RUTLAND, Vt. (WCAX) New details about the teen accused of plotting to shoot up a Vermont high school. Jack Sawyer of Poultney was in court again Friday morning. The 18-year-old faces charges that could put him behind bars for life. But the defense wants all those charges tossed.

In day two of Jack Sawyer's evidence hearing, Vt. State Police Sgt. Henry Alberico, the state's witness, again took the stand, detailing what he says happened during Sawyer's interview with police after his arrest.

In his interview and in a journal he kept for three months, Sawyer describes a detailed plan to attack Fair Haven Union High School, including taking out the school's armed security guard and killing as many people as possible.

"As quickly as I can pull the trigger is how many casualties," Sawyer said in the recording.

The state says the interview with police, written evidence in Sawyer's journal and purchasing a gun and ammunition is enough to charge the 18-year-old with four felonies, including first-degree attempted murder. If convicted, Sawyer would face a life sentence with no parole.

"He had every intention of following through," Alberico said.

But is intent strong enough evidence?

"The weight of evidence is not great in this case," defense lawyer Kelly Green said.

Green says it's not strong enough and all the charges against Sawyer should be dropped.

"What he did was prepare for an attempt. He didn't actually attempt. That's a big difference," Green said.

Green points to Sawyer's struggle with mental health issues and that he had stopped taking his medications. She also says on Feb. 11, Sawyer allegedly sent messages to a friend stating he was no longer planning to go through with the attack. Green says her client's change in heart and attempt to get a job and apartment shows he was trying to "manage."

Prosecutors point out that later in text messages to the same friend-- and in his interview with them-- Sawyer told a different story.

Sgt. Henry Alberico: To save money to fulfill his wish list or his items needed to fulfill his plan.

In the courtroom sat Brittany Cavacas, a daughter of two Fair Haven High School employees.

"To have the defense say that there is nothing there... we know that there is something there and we need to protect our kids," Cavacas said.

Green said that she plans to file a motion Monday to dismiss all charges.

Basically, Kelly Green is trying to take after Johnnie Cochran. If she gets the charges dropped and decides to commit to his plans, the blood will be on her hands as well.

RUTLAND, Vt. (WCAX) Gov. Phil Scott says the alleged plot to shoot up Fair Haven Union High School prompted him to push for gun control. Now, one of the new laws signed Wednesday by the governor is being used to deny would-be shooter, Jack Sawyer, his guns.

Vt. Superior Court Judge Nancy Corsones on Wednesday signed an emergency extreme risk protection order. It went into effect even before the ink dried and it says Sawyer, 18, cannot purchase, possess or receive a dangerous weapon. The judge issued the emergency order after determining Sawyer poses an extreme risk of physical harm to himself or others.

Sawyer must surrender all of his dangerous weapons. There is a hearing set for April 25 to determine if the emergency extreme risk protection order on Sawyer stays in effect. And if it does, for how long.

According to the state's online inmate tracker, Sawyer is being held at the Marble Valley Regional Correctional Facility in Rutland. He is charged with aggravated attempted murder for his alleged plot against his former high school. But the Vermont Supreme Court ruled this week the Poultney teen deserves bail, pointing to prior rulings in Vermont that preparation alone was not enough to prove an attempt.

There was no scheduled bail hearing when WCAX News spoke with the Rutland Courthouse Friday.

We reached out to the Rutland County state's attorney and Sawyer's lawyer for more information on the case, but we had not yet heard back when this story was published.

BURLINGTON, Vt. (WCAX) Governor Phil Scott is responding to community concern over Jack Sawyer, the 18-year-old accused of writing out plans to shoot up Fair Haven Union High School.

The Supreme Court ruled there was not enough evidence to hold Sawyer on an attempted murder charge, meaning Sawyer will likely be released on bail, and the case could be dismissed.

In a statement released Friday, Gov. Scott said in part: “I’m appalled by Mr. Sawyer’s potential release… My Administration is actively working with the Rutland County State's Attorney, The Vermont Association of States Attorneys, local law enforcement, the Vermont State Police and the U.S. Attorney to identify any and all legal avenues to keep this individual in custody.”

For Angela McDevitt, the possibility of Sawyer’s release is worrisome.

“I'm just scared,” she said. “I didn't sleep at all, I was very upset, I didn't go to school today.”

In 2016, McDevitt said she attended a mental health treatment program at the same time as Sawyer. In February, McDevitt told police she was concerned Sawyer might be a threat. Investigators later found the detailed plot to attack Fair Haven Union High School allegedly written in Sawyer’s journal.

“It is scary, and there are even students in my school texting me with the same thoughts saying, what if he comes to our school now because his school has more security?” McDevitt told Channel 3 on Friday.

Gov. Scott echoed those fears.

“I’m also concerned for the brave young woman who reported him,” he said in his statement. “I’ve directed the Department of Public Safety to ensure they have open and ongoing communication with law enforcement in her community.”

In total, the governor said nine agencies spanning Vermont and New York are prepared to provide resources to help in the event of Sawyer’s release.

“Even though the new laws we signed Wednesday allow us to prohibit his access to guns, I believe that anyone who takes so many specific steps to prepare to commit a horrific crime, and then confesses he is working to carry it out, needs to be held fully accountable,” Scott said.
The governor is now urging the Vermont legislature to fast-track new laws that would close the loophole in the law of ‘attempt’ that could allow Sawyer’s release.

“I’m calling on the Legislature…to establish a domestic terrorism statute that most other states have -- and to do so immediately and before Fair Haven High School Students return from their April vacation.”

Across the state line, McDevitt said she’s hoping Sawyer understands her intent to keep others safe.

“My heart wants to believe that Jack is not going to hurt me, because the person I knew would not hurt me,” McDevitt said. “But I could be a target to him.”

“Based on the evidence in the public record, it is clear the individual intended and still intends to carry out a horrific crime. I’ve heard from the school’s superintendent as well as the Rutland County legislative delegation on the fear and frustration the community is feeling, and I share that frustration and concern.

“I’m appalled by Mr. Sawyer’s potential release and I’ve instructed the Department of Public Safety and all agencies to do everything they can to assist the Rutland County States Attorney in holding this individual accountable, help the Legislature close any loopholes in the law his defense attorneys exploit, and support the school and the community with additional law enforcement resources.

“I’m also concerned for the brave young woman who reported him, and I’ve directed the Department of Public Safety to ensure they have open and ongoing communication with law enforcement in her community.

“The first priority has been to do all we can do to support the Fair Haven Police Department ensure the safety of the school and community should this individual be released for any reason. The state, school and local officials are taking the following steps:

• My Administration is actively working with the Rutland County States Attorney, The Vermont Association of States Attorneys, local law enforcement, the Vermont State Police and the U.S. Attorney to identify any and all legal avenues to keep this individual in custody;
• The Vermont State Police (VSP) is engaged with all law enforcement partners and school officials in preparation for Mr. Sawyer’s potential release;
• VSP has worked with State’s Attorney Rose Kennedy who has obtained an emergency Extreme Risk Protection Order as provided for in S.221, signed into law this week, prohibiting Sawyer from possessing firearms;
• VSP has been in regular communication with Fair Haven School officials and local law enforcement, and in contact with Sawyer’s parents, who have been engaged and cooperative;
• VSP has offered substantial State Police resources including personnel, enhanced communications tools, patrols and additional onsite safety capabilities;
• The Fair Haven Police Department has met with school officials, offering increased staffing for the remainder of the school year, including ensuring a school resource officer on all school days; and
• The Addison-Rutland Supervisory Union, which includes the Fair Haven School District, has also instituted additional safety precautions, including a security audit, limiting access to the school, issuing a No Trespassing Order against Sawyer and installing additional security infrastructure.

“In total, nine law enforcement agencies, including state and local agencies in both Vermont and New York, are prepared to provide resources to the school and community and they are prepared to keep the school and community safe, should this individual be released.

“Beyond these immediate safety precautions, we are taking additional action at the state level. The mere possibility that someone with a clear intent to murder innocent children could be back on the street shows there is an unacceptable loophole in our current criminal law. Even though the new laws we signed Wednesday allow us to prohibit his access to guns, I believe that anyone who takes so many specific steps to prepare to commit a horrific crime, and then confesses he is working to carry it out, needs to be held fully accountable.

“That’s why I’m calling on the Legislature to act quickly to close existing loopholes relating to the law of ‘attempt’ and to establish a domestic terrorism statute that most other states have -- and to do so immediately and before Fair Haven High School Students return from their April vacation.

“My Administration has already begun working with the State’s Attorneys, Attorney General’s Office and the Legislature to improve our criminal law to address this and we look forward to working with the Legislature to complete this work quickly.”
