Japan’s Detention Center Holds Many Without Convictions​

Former Nissan Chairman Carlos Ghosn recently was held in the Tokyo Detention House, which looks like a high-security prison. Most of its inmates, however, are like Ghosn: they are being held there but have not been convicted of a crime.

Japan has a system that often refuses bail while suspects await trial. Law enforcement officials may hold suspects for months. Many international observers have criticized this system calling it, “hostage justice.”

International reporters got a rare tour of the plain, but orderly detention building on Monday. They were shown the floors that do not house detainees, or inmates.

Each cell is for one inmate. It has a toilet, bedding, a shelf and a sink. A window looks out into a small area of sky. Simple meals of rice and soup with a small piece of meat or fish are served out of a sliding window.

Ghosn spent more than 100 days at the detention center over several separate detention periods. He says he is innocent of financial crimes.

Currently, Ghosn is out awaiting trial. But 1,216 of the 1,758 current inmates have not been convicted. They are in prison and are awaiting trial.

A single cell measures 7.5 square meters. The tour also showed a small exercise area. Inmates can go there for just 30 minutes a day.

There is also a small store where visitors and inmates can buy snacks.

Many nations have bad detention conditions. In Thailand, for example, suspects can be held in chains as they wait for a trial.

Detentions can also be long in the United States, especially for people suspected of serious crimes such as terrorism. But generally, a person is considered innocent and has the right to have a lawyer present when they are questioned. A suspect is freed within 72 hours if there is no charge.

Suspects in Japan can be questioned by officials without a lawyer present. They can be held up to 23 days for each possible charge without the possibility of bail. Government lawyers can add charges to lengthen the detention.

The interrogation rooms where suspects are questioned were not shown during the tour.

Warden Shigeru Takenaka agreed conditions could be improved. But, he said that public opinion would not accept “fancy” conditions.

Those suspected of a crime are ostracized in Japan. The social shame means few people speak out against conditions in the center.

Those who do say they felt without hope at the Tokyo Detention House.

Yuji Hosono is a former representative partner at the financial company KPMG Japan. He was detained for 90 days after he was accused of faking financial records. He said he thought it would never end.

He was convicted after taking his case to the Supreme Court.

He said some workers at the Tokyo Detention House were nice. When going to be questioned, they told him to “hang in there.”

Foreigners make up 14% of those at the detention house. About one third of the inmates are from China, followed by Vietnam and South Korea. Americans make up 4% of the foreign inmates.

The most common charge is theft, followed by drug use.

Takenaka stressed that his inmates were safe, unlike American prisons where violence is common.

“They don’t have to defend themselves as in the West. They are protected,” he told reporters.

At least the food is good.

okay, I have consulted someone more familiar with the Japanese law and crime culture, and this is what she had to say with Somali situation:

1. )what all he did are considered "small crimes" in Japan, he can only get an court appointed lawyer if he is being indicted. Since he is being piled on charges upon charges, the best possible action here is to hire a private lawyer, private defense lawyer in Japan are expensive, since they are basically putting a black mark in their resume/record for defending a criminal in a country with a 99% conviction rate.

2.)if you are being re-arrested again. that's it. the police and the judge is determined to convict you and put you in jail. and they most likely want to put you behind bars for at least 10 years. most "small crimes" in Japan can easily be dismissed if you show remorse and apologize and compensate for the damages. but in Somali's case, since it is broadcasted in TV in Japan, a politician brigading and advocating for stronger laws and implementation, Somali has little to no chance to have a deal. In case of a miracle, he will be paraded around and make a huge press conference with apologizing and some scripted apologies and promise to do better, blah blah blah.

3.)the trespassing in the construction area has high chances for the charges to be dropped. after all, there's a lot of trespassing punks that do some tagging shit at the dead of the night. now the one with his stupid stunt of getting in a truck has a high chance of being charged as attempted theft.

4.)most likely he will not be charged with illegally filming people. although there is a strict privacy law, most people will not bother to pursue suing a guy for not getting permission being filmed.

5.)he will be most likely separately charged with multiple disturbing the peace in restaurants and illegally filming in restaurants. she said that this is probably the highest chance of the crimes Somali will be charged with.
Japan has a very competitive food culture. restaurants are very secretive regarding their recipes and stuff. so unless you have very specific permission to go inside their kitchen and film on how they do things, the restaurants get really angry. the only rare restaurants that aren't bothered being filmed are the tourist traps and some that are very accommodating and wants you to promote their restaurant.

he was actually being stopped by police multiple times. those were the times that he was actually reported to the police, most likely to warn him but also building a case against him. his guide should have warned him at this point since he is being stopped by police constantly

The age of consent being 13 was always just a meme because of a midunderstanding of the law in Japan, if you ever actually tried to have sex with even a 16 year old you would likely get arrested for their equevalent of corruption of a minor law.

Why do they say age of consent is 13? Because that's simply that's the age where it's no longer considered rape, and instead it falls under the purview of various laws covering the corruption of a minor, and get this shit, you were still considered a minor until you turned 20, which is why in some mangas that are faithfully translated sometimes you see a 19 year old commiting crimes and pointing out to a older character they won't face conquences but they will, because they're still legally considered a juvenile criminally.

Yes in Japan, until this year, legally speaking, any porno featuring a 18 or 19 year old that was literally a MiNoR meaning per the inane American standards tHaT'S A FuCkInG ChIlD YoU SiCk fUcK; but that aside, and disturbingly, 18 or 19 year old could star in Japanese porn prior to this year, because it's legal to be in pornography at 18, but they had to have their legal guardians sign off on it and had the right to have it pulled after they turned 20.
 
So, I don’t disagree with your main point of not believing the news, but I have some points of contention with your later reasonings.

First off, Japan is a coomer country obsessed with order and discipline, so I could fully believe that they would be harsher on someone flagrantly breaking the rules than they would be on child porn (keep in mind, they’re all sexual deviants in Japan to SOME degree).

I have read and seen alot of nasty shit, but holy god this story is horrible, what's worse is the four main freaks that raped and tortured ( I mean tortured in the truest sense of the word) for 44 days, are all free. The japs have a real sadistic side, there seems to be alot of emotional repression due to their honor culture. Not just with their anger but with sex as well. I'm excited for the prison streams and I'm glad to see old cx members joining, but dear God I can not stand Burger and Salmon Andy. I think the only ip2/cx streamer as bad as them is skimask andy. I hate how every ip2 viewer flip flops on who they claim to like. Remember when Salmon allegedly lit the fire outside the RV and everyone hated him. Ever since he called out Alisa Jordana for being friends with her irl paypig they've been sucking him off again.
