The 1st step to spitballing the legal status of the posts would be digging up caselaw. Then dig into cases that have convictions, even if they never went to appeal to look up what the DA's argued to gauge how much legal risk one might have depending on the patposting. That WI case I cited seems to have lost whatever protection might have existed via free speech because the speech was shocking to the sensibilities. Calling in bomb threats is not protected. And I'd bet the posted SMS message of 'here is Elon raping you Pat' would also not be protected, same with Patrick calling for the rape of someone.
Patposting that will get a reaction from Patrick in ways others say "that was funny" is trying to catch falling knives. Not a game to bother playing in my world, but to each their own.

The idea of having "the public" look at data to come to a conclusion is already being done. In fact Jackie has named the place I'm thinking of in 2023. But doing a site like where 'the public' can contribute will need moderation and that isn't a job Ms. Butt Legal can do on the proposed budget.
What will kill the place will be the fights over what a threat is.
