I think you guys both have interesting points, and I think they're both valid. It does feel like a bit of a double edged sword here, if that's the right analogy to use. You take direct action, and it limits their reach to some extent. You do nothing, and... I wouldn't say you would necessarily be complicit in their reach, but you're just being passive about it, in a way. I think you can figure out what I'm trying to say, here. This being said, if you let it continue, and give them just enough rope to hang themselves, it pays dividends. But you're more or less waiting on something that may or may not be guaranteed to happen, or it may simply not happen.

However, my thoughts have been swayed on the issue. If you read back to my post on page 254, I believe, I mentioned that I have extremely intimate experience with what sex predators do. Regardless of what anyone here's common sense might dictate about whether "having MtF transgender participants in the change rooms would make the other contestants uncomfortable " is a legitimate rationale for banning them, it probably wouldn't fly as a "bona fide and reasonable justification" under human rights laws in most provinces (including BC). I base this on the fact that BC schools have already decided that students can use bathrooms and locker rooms that correspond with their gender identity; although this wasn't prompted by a Human Rights Tribunal ruling, it was done because it was fully anticipated by the school boards that if they decided otherwise, they would lose once a human rights complaint was filed.

The biggest issue for Yaniv with his human rights complaints about the pageants is the jurisdictional one. I'm not going to wade through hundreds of posts to try to sort out which pageants he's filing against and what jurisdiction they would fall under. But that one organizer who explicitly told him they were refusing him on the basis of him being trans, and explicitly included the "natural born female" requirement in their materials, was quite stupid to do so. If I recall correctly, that one was based out of Ontario. Ontario has a similar human rights code to BC, and gender identity/expression is a protected ground under it as well.

I would love to be wrong about this, but based on my understanding I unfortunately believe that if he gets his shit together and files in the right province, Yaniv more likely than not actually does have a meritorious complaint as far as the law is concerned. While this is very informative, I’d recommend we don’t find/point out any merit in his cases. We know Jonathan stalks his thread every waking hour, the last thing he needs is more information on ways to exploit businesses/pageants/women/etc.

I'm just explaining why, unfortunately, I don't expect it to be laughed out of the tribunal once he files in the right place. And the BCHRT will explain the jurisdictional issue to him in their reasons when they reject the complaint regardless.

First - You need a victim to come forward and file a complaint with the police. You can imagine that predators like Yaniv are really good at grooming their victims, ensuring there's enough stockholm syndrome going on to ensure that they don't disclose or report. It could take years for said victim to even get the courage to come forth and make disclosure. Yaniv, like any other predator, isn't going to come out and admit that there's a victim.

Second - You need a victim. Said victim will probably be a minor, as it seems to be underage girls that Yaniv is drawn to. The damage is already done.

As Oger pointed out - one of the pageants takes place on a boat. That boat is not registered to a port in Canada. The company putting on that pageant is based out of Florida. There's no jurisdiction under any Canadian law whatsoever, and Yaniv will be utterly shocked to find that Florida's state laws aren't as insane as our provincial law.

The other pageant is an Ontario company. Ontario has its own legislative body, human rights code, and human rights tribunal. Oh - and their tribunal can and does award costs.

While I hate to give away some strategy - I don't think Yaniv the emotional capacity or the maturity to avoid anything I'm saying.

Many keep asking why Yaniv isn't in prison or in an institution yet - that's because the police and the medical establishment need a reason. You're suggesting that said reason could be the sexual assault of a minor if we simply bide our time. Well, there's two problems with that - and they're both the same problem. You need a victim.

First - You need a victim to come forward and file a complaint with the police. You can imagine that predators like Yaniv are really good at grooming their victims, ensuring there's enough stockholm syndrome going on to ensure that they don't disclose or report. It could take years for said victim to even get the courage to come forth and make disclosure. Yaniv, like any other predator, isn't going to come out and admit that there's a victim.

Second - You need a victim. Said victim will probably be a minor, as it seems to be underage girls that Yaniv is drawn to. The damage is already done.

Remember - in order for Yaniv to be arrested or hospitalized, the authorities need a reason. Capone was a notorious mobster, and untouchable. But they nailed his ass with tax evasion. I really get the feeling I should be lurking. And I will, following this reply. (Or, that will be the idea...) You bring up very, very good points, and I think we can all agree that the last thing any of us wants is an actual victim. I'm not afraid to say when I don't have an answer. I'd rather give no answer than a wrong, or a bad one. I don't want to impact the work you guys are doing in any way, so I'm not going to.

I will follow this case closely, though, because it's the classic train wreck effect. I can't look away now. I just hope, for all involved, the right things happen before any (more) harm gets done. This said, I'm off to lurk.

Keep doing what you're doing, all. I might be a dumb noob, but that doesn't mean I can't appreciate the work you guys do, and the skill you guys put in. I think this cow is one to leave to the experts in the room. You really are doing GodJesus' work, and that's not me blowing smoke up your arse.
