If he published it in a public forum, there is no reasonable expectation of privacy. Moreover, if he already published it to a public forum, he likely has little footing for making a case. In your appeal, you can also bring up the fact that he was chastised by the BCHRT for abuse of process, which is what he's doing by trying to "punish" people for publishing news.

So you can dig in your heels and argue your case without getting "the itch".
