I apologize for taking a week to respond to this--I've been very busy IRL.

Just to clarify: I've seen quite a few posts here about JY or others "be[ing] in a protected class," but that's not how human rights legislation works. There are grounds of protection, but (legally, at least, regardless of how they tend to operate in practice) they aren't a matter of specific individuals falling under them or not. They are bases of discrimination that are disallowed--e.g. "sex" being a protected ground of discrimination doesn't only narrowly mean that one can't discriminate against women specifically. I know this is pedantic of me, but these things are often framed in a way that's technically incorrect.

Anyways, to actually answer your question, you are correct. In BC you can't discriminate against someone on the basis of "gender identity or expression," but you absolutely can deny service to a (self-proclaimed) transperson on other bases (e.g. their violating privacy, harassing people, etc).

This is wrong. In Canada, positions involving working with children require "vulnerable sector" police information checks. It's not only convictions that show up on them--charges, arrests, etc in relation to relevant offences that did not result in convictions will still be flagged.

You're correct that shady behaviour that did not result in any police contact won't show up, though.

The relevant section would be Section 2(b) of the Charter, which grants freedom of expression. The application to speaking before a municipal council would be complicated though, as freedom of expression usually only requires that the government refrain from interfering with one's expression, and doesn't require them to provide a platform for expression. "The traditional view, in colloquial terms, is that the freedom of expression contained in s. 2 (b) prohibits gags, but does not compel the distribution of megaphones." - Haig v Canada

The Local Government Act does, however, include a number of sections outlining duties that councilors have to their constituents, situations in which constituents must be heard, etc.

Expressly advertising that you won't provide services to transgender people would definitely violate the BC Human Rights Code. The situation with the waxing salons is only ambiguous because the difference in the customer's genitalia is actually relevant to the service being provided.

I've been following JY on and off for a little while now. I've never understood why he treats #waxmyballs as such a huge thing. Is it to try and m.ilk money out of poor small business owners, or is he really this delusional? Or is there some kind of sexual bent to all this? I know he's gross, but that's kinda what makes me even more curious. It's the classic train wreck effect. You know you shouldn't look, you know it's completely terrible, but you also can't turn away for a second.

P.S. I know this is very late, but you have to start somewhere, and this guy is interesting to me, for all the wrong reasons.

Combination of sexual bent and scam effort. He is well-documented to be both a pervert and scam artist, and he did indeed get his balls waxed by a few businesses that didn't refuse him, while he offered to withdraw the complaints against those who did refuse in exchange for cash payments.

He only started his public "transgender activism" shtick after he was outed as the complainant in the Human Rights Tribunal cases, so it's an obvious, clumsy cover attempt.
