Two of four men were acquitted Friday in a conspiracy to kidnap Michigan Gov. Gretchen Whitmer in 2020, motivated by fury at the Democrat’s tough COVID-19 restrictions early in the pandemic.

The jury’s verdicts against Daniel Harris and Brandon Caserta were read in the federal court in Grand Rapids, Michigan, in the case presided over by U.S. District Judge Robert Jonker. Jurors said they couldn’t agree on verdicts again Adam Fox and Barry Croft Jr. Prosecutors described Fox as a ringleader of an anti-government group.

Earlier in the day, the jurors said that there are several counts which the deliberative body are deadlocked on. Testimony began on March 9.

"It is not unusual to come back somewhere along the line of deliberations and say 'we tried, but couldn’t get there,'" Judge Robert Jonker said, according to Detroit News. "At least not on everything."

Jonker encouraged the jurors to continue deliberations in hopes of reaching a unanimous decision, saying, "Before that’s the final answer, I would like you to go back and make another effort to see if you can come to an agreement on issues you are stuck on as a group."

Fox, Croft and Harris faced additional charges. The two most serious charges, kidnapping conspiracy and conspiracy to use explosives, both carry potential life sentences.

The trial has lasted over 20 days as the public awaits the final decision on defendants Barry Croft, Adam Fox, Daniel Harris and Brandon Caserta. Prosecutors say they turned their anger toward government in 2020 into a plot to kidnap Whitmer because of the restrictions she imposed during the early months of the pandemic.

Defense lawyers claim informants and undercover agents improperly influenced the men.

Whitmer, a Democrat who is seeking reelection, rarely talks publicly about the case. She has blamed former President Donald Trump for fomenting anger over coronavirus restrictions and refusing to condemn right-wing extremists like those charged in the case. She has said Trump was complicit in the Jan. 6 Capitol riot.

A man upset over state-ordered coronavirus restrictions was sentenced to just over six years in prison last year after admitting to involvement in the plot – a significant break that reflected his quick decision to cooperate and help agents build cases against others.

Ty Garbin admitted his role in the alleged scheme weeks after his arrest last fall. He is among six mencharged in federal court but the only one to plead guilty so far. It was a key victory for prosecutors as they try to prove an astonishing plot against the others.

Garbin apologized to Whitmer, who was not in court, and her family.

Don't play the card that these guys were innocent - they aren't. The 2 that plead out plead out for a good reason. Obviously there are degrees of involvement which is why the 6 are not all facing equal scrutiny.

Don't take the mistrial as some sign that these punks are free and clear - far from it to make that call.

And moreover, don't take that 2 were found not guilty means 2 plead out that were ACTUALLy Innocent - because they weren't.

You are essentially the type of person who groups hope in the future, they can use as patsies to do their dirty work. If you are this easy to sucker now, it won't be a problem in 10 years to make you believe anything, although you probably already do.

Actually the reason we are supporting them is because there is ample evidence this plot was completely planned, funded and executed by the FBI. The special agent who orchestrated the entire scheme turned out to be a violent drunk, more then half of the co-conspirators are federal agents themselves and out the entire group involved they could only charge 6 people because out of the 30 or so people in this "plot" they were arguably the only ones who were NOT feds.

If we are going to arrest people for plotting to kidnap Whitmer, the people involved in the scheme are in Washington DC, not Michigan. As for the two guilty pleas, they caved to pressure, not because they actually believed they did anything wrong. Many such stories in the federal courts

Don't play the card that these guys were innocent - they aren't. The 2 that plead out plead out for a good reason.

You must not be from the US, so I'll explain. You are presumed innocent. That is the default. If you are not found guilty, then you are presumed innocent. Innocence isn't proven (*since it can't be), it is presumed. Guilt has to be proven, and if it isn't, then you are not guilty. There is no such thing as being found innocent. You are either found guilty, or not guilty. Innocence is presumed.

[*To illustrate the idea that you can't prove innocence, if I were to accuse you of killing and eating a puppy in August 2018, could you prove that you didn't? Of course not, so it would be on me to prove that you did.]

As to why anybody would plea out, I'll explain that too. Imagine yourself arrested and imprisoned unable to make bail, and facing 20-30 years in prison, being charged by the same people you are accused of trying to kidnap or kill, so you know they have a vested interest in seeing you rot. Your court appointed lawyer comes to you and says, "I doubt we can beat this, but if you plea to this lesser charge you'll be out in 18-24 months and be able to put this behind you. Otherwise, you'll be locked up for at least that long just going to trial and then will probably still get found guilty".

This is exactly how the system works. People take these deals all the time because they know just because you're not guilty doesn't mean you'll win at trial.

As a side note it's interesting how this story isn't on the front page of the Detroit News site, since it was all over the front page for months before. But now that the case has fallen apart, they've buried the story.
