Maybe the right doesn't legislate from the bench because they're all about preserving stuff, it's the left that wants change.Ironically, this is an issue largely of the left's making. Their judges largely try to legislate from the bench rather than interpret the law. This is not to say none on the right due, Scalia comes to mind, but largely right wing judges were not the kind to legislate from the bench. So, why do I say the left did it? Well, when you have a force clearly pulling against what the purpose of your office is, the reaction is to pull in the opposite direction. Thus, party line votes.
