Alright, let’s see if we can figure this out. Just be patient, American tax code is a little foreign to me. Seems like there is a SGA for SSI, both SSDI and SSI fall under the same SSA guidelines.

He’s accepting tips from his PayPal Business account and they have to be classified under federal law as self employment income, PayPal will report that income as business income regardless of your situation. Since he’s not using a personal account, he can’t accept donations under friends and family having it count as a gift or something that can’t be taxed. I’m assuming Josh isn’t accepting donations as a non-profit. I mean, it makes sense that he wasn’t banged last year too. The maximum income for PayPal was $20,000 before the IRS started coming around, this year it’s $600.

This is just donations. He has to justify the amount of money he makes for products and operating a small business, he sells his t-shirts and sells his wands. This is gunna get really hairy for him really soon, I have no idea how Clint is going to justify any of this or have Josh avoid losing his SSI.

That’s not correct. There is no sga for ssi once on it. You have to be under sga to qualify for it, but once you’re approved there is no sga on ssi. Ssdi, yes.

Regarding donations, I was assuming he was getting him as a friends and family thing. Dumb of him to accept it under a business account

For SSI, we use SGA as a factor to decide if you have a disability when you apply based on a condition other than blindness. (SGA is not a factor for SSI applicants who are blind.) We use the same SGA level under SSI for applicants with impairments other than blindness as we do in SSDI.

For SSI, we do NOT use SGA as a factor to decide if your disability continues when you are already on the rolls. Your SSI eligibility continues until you recover medically or we end your eligibility for a nondisability-related reason.

He’s cognitively impaired, that is why he gets it. So since he is on it already, sga doesn’t apply to him. What it means for blind people is when they apply, there is no sga number for them. That’s all.

Think of it like this at the initial application level:

Non blind: make sga - ssi denial

Non blind: makes under sga - meets medical requirements- approved

Blind: makes over sga - doesn’t matter - approved

Upon approval: sga no longer matters for ssi. Benefits will just be suspended if you make too much and resume if your earnings go down

Actually commit fraud, though, on the means-testing part, and they'll come after you retroactively for money you wrongfully obtained. They'll do that even if it's accidental but they'll go out of their way to fuck you for actual fraud, whereas for non-fraudulent, they'll usually allow you to pay it off over a long period of time just in reduced checks.

He'd probably have a reasonable argument he's such a retard he didn't intentionally commit fraud.

It's a bureaucratic distinction. The means-testing part means you need to be in dire poverty to continue to get it, even if you're still "legally disabled." Like someone who owns a house or has substantial savings has to spend it down to qualify.

Even a part-time job can partially disqualify you, so whether it's specifically SGA or not doesn't matter. Any job that would qualify as SGA (i.e. 40 hours a week minimum wage) would disqualify you on the means-testing part.

If you were on SSDI and suddenly went back to work and had an open period of disability, it would become a closed period and you'd have to prove you'd become re-disabled later. This is somewhat perverse as it discourages people from even trying to go back to work on SSDI lest they risk having to go through the bizarre, labyrinthine disability determination phase again.

It would help if you were pulling this directly from the federal gov for SSI and not some Pennsylvania one.

He's on SSI, that means his income has to be under a certain amount or else his SSI begins to be reduced. The chart on this is just about eligibility, if he was making more than 1.9k (and this is adjusted for inflation, it was less when he actually got on SSI) he wouldn't be on it, but now that he's on it, half the money he makes over $65 dollars in a month starts to count against how much he receives.

Also, SSA rules are federal so it doesn't matter where the info comes from. DDS employees are state employees who evaluate the medical portion of the claim. It's inconsequential.

I've always suspected he pays for his rent through the SSI, but he recently mentioned he was putting money towards rent, so perhaps he's already been dealing with his SSI being lowered and the whole "they're going to find out!" bit is null.

That would mean his SSI is reduced a third due to in kind support, which lowers the amount needed to make an ssi check go to zero.

I don't think Cobes can be blamed, Clint will be responsible because he is the rep payee. The rep payee has the duty to report. Part of this is the law change where natural parents who are rep payees no longer have to fill out accounting reports, but rep payees are still responsible for reporting income changes in the case of SSI.

He is though. Cyrax is blind in one eye and has greatly diminished vision in the other. He's just too stupid to apply for benefits. Or he may be a felon. And stupid.

Not to bring cyraxx discussion into this, but he's mentioned needing to move states due to benefits and shit so he's definitly on benefits. Sally's just the payee most likely and gives cyrax a pittance if anything.

That would kinda make sense. His rent consumes the entirety of his check, anything after that he has to pay himself. He’s been paying utilities and his internet bill himself since he moved into the new place, at least that’s what he’s made known.

Anyway, it’s good to have this all ironed out by someone who intimately understands the topic. ‘Preciate it, dood. This is why I come here, you guys nail shit down better than most.

My favorite aspect of Cobes is how he legit thinks people respect him for his "drink combos". He is even mixing non-alcoholic drinks now. G-Fuel and Mountain Dew mixing is beyond retarded.
Also how likely is it that Josh already blew through most of the $500 he got in donations and is only making a video because he already needs more.
