I want to read the explanation for this.
@Schuylkill Valley

Did you read this post of mine? I seriously want to know why you agreed with my story edit post because there's no way in hell you have enough awareness to agree with what I said consciously.

I can't wait for all the stories that are gonna come out of that trial about Shaner being delusional enough to defend himself without an attorney. He's gonna fail so hard even after just making his case even worse recently.

He's an idiot, obviously, and should go with the PD. If he'd just been charged with simple trespassing, it would only be a summary offense and he wouldn't be entitled to counsel (unless Pennsylvania does provide counsel under such circumstances which I doubt). As it is, though, he's charged under 18 Pa. C.S. § 3503 (b)(1)(i).

Specifically, [a] person commits an offense if, knowing that he is not licensed or privileged to do so, he enters or remains in any place as to which notice against trespass is given by. . .actual communication to the actor[.]

As subparagraph (2) explains:

[A]n offense under this subsection constitutes a misdemeanor of the third degree if the offender defies an order to leave personally communicated to him by the owner of the premises or other authorized person[.]

I.e., he was told to fuck off in no uncertain terms by a person authorized to tell him to do so, and did not do so, being the giant autistic dumbass that he is.

Actually, he has three other counts of reckless endangerment too. That's actually a somewhat more serious offense.

A person commits a misdemeanor of the second degree if he recklessly engages in conduct which places or may place another person in danger of death or serious bodily injury.

Anyone who wants to do sentencing math on these could check out this site.

In theory, he could end up in prison if consecutively sentenced on all four charges, as opposed to concurrently. In practice, it's pretty likely they'd be sentenced concurrently, be under 12 months, and even more likely be less than that. A fine or something.

This is not legal advice to anyone, even retarded, autistic, barely literate fat mongoloids reading this thread by the name of Leonard F. Shaner, Jr. It is especially not legal advice to Shaner. Except the part about actually getting a real lawyer, which is the only legal advice anyone should get or give on the Internet.
