Hey, so where are we on the whole transcript thing by the way?
From what I understand, the most recent thing (his arraignment) was waived by the defense, therefor no transcript. I think we're all pretty much in agreement on that one.
For his first court interaction I previously said that stenos aren't normally used at that level of just appearing before the DJ in PA like that. Either side can specifically request to have a steno present, but they have to pay extra for this service. This is typically only done if one side thinks that a witness will change their testimony along the way so they can quote earlier testimony. From what I've heard of the first hearing there was no steno present. No steno means no official transcript, just the result is filed, and that's what we've seen on his docket sheets. I don't think we're all in agreement on this idea, however. While it would be neat if there were audio recordings and all of the other things speculated I do not see this as a possibility, but I think I am in the minority.
The next round is a pretrial conference, which is like a quick mini-trial before the judge only (no jury). This is where a typical defense attorney will try to exclude evidence or exclude witness testimony, with the goal to get charges reduced or thrown out due to the new level of evidence. Given the behavior to date of Len and his earlier representation, the pretrial should be a hoot and a half.
There has been some questions/speculations that Hy may no longer be Len's attorney as he wasn't listed with the recent filing to waive the hearing and its formal reading of the charges. Personally, my thinking/hope is that Hy may have told Len, "You can save some money and just waive this yourself, you don't need me; it is pretty simple" leaving Hy to still be in the picture. Total speculation on my part with this one.
While it would be entertaining on one level for Len to represent himself, as I'm sure he'd be quite the hot-head, I am rooting for Hy to continue to represent him. I find it a lot funnier when two people or more are on board with the crazy, not just one. Think of it like a one-man show versus a whole Broadway production. Actually, it doesn't matter to me if it is specifically Hy representing him as it is just as funny for me to have any attorney going along with Len's delusions.
