The justice system is irreparable. You have a system that is "justice is blind" and treats everybody the same, but wherein most of the offenders are a minority demographic that can't be acknowledged. So people default to a "tough on crime" stance that results in everyone being treated harshly, because you need that for the minority offenders who can't be acknowledged because justice is supposed to be blind. The result is a punitive justice system with zero effective rehabilitative programs that grinds up the non-minority offenders.
The entire US can be described in this sort of way. Why is healthcare broken? Why is education broken? Why is the police system broken? Why is government broken? Why are elections unsatisfactory and why do they achieve no meaningful change? Answer for all of these things: we have an equal society compromised of unequals. All systems developed must treat everyone the same, when they are not.
