Yes, you could aim for an "all is fair approach", but that means the tormentors go scot free again (same shit that happened in the 60s and we know how that ended) and any chance to bring decorum back on the table through public shaming is lost.
And I have to insist on this. Public shaming/consequences is how you get people to behave except for the outliers. One third is overly cowed and bloodthirsty and the other 3rd has 0 filter.
