Mario 64 gets native pc port 9 months after source code decompiled

Nintendo is debatably within their rights to nuke it since this involves source code decompilation. Which is probably not considered fair use. If someone reverse engineered the engine from scratch and didn't reuse code then they'd probably be okay.

However Nintendo doesn't generally care about rights and will go after fan projects even if they have incredibly shaky grounds legally. A good example is they went after Pokemon Prism even though that's a romhack and they didn't distribute a rom with it. Just a patch that you apply to an existing rom.

They don't go after emulators because those have actually been defended in court and are protected by legal precedent.

...I still don't like it. I thought the controls having laggy inputs was a hardware flaw due to the low frame-rate of the original, but either it's a deliberate design choice, or this version is intentionally mimicking the input lag to preserve the original experience as possible. I suppose in a way that's a good thing, since it means both fans and speedrunners will be able to pick up this version and immediately be familiar with how this game feels to play, but for an outsider like myself, it's a pretty rough experience.

That being said, I'd be interested in seeing what the modding community can do with this now that the game's code is out in the open. Can you imagine a version of Mario 64 where the camera doesn't gargle horse cocks? What a wild world that would be.

You're being incredibly lenient if you think it's even remotely debatable, any US court would easily rule in Nintendo's favor here, let alone places that are stricter like Japan. You mentioned the emulator lawsuit, as far as I understand emulators are okay as long as they don't use the code from what it's emulating, as that would be copyrighted. The SM64 port would be definitely be violating that rule as it's just it's just straight up built from Mario 64 down to the source code. But even if you reversed engineered the whole game it wouldn't matter, it's still a breech of IP, even with code aside all of the characters, levels, music, etc. fall under copyright. Given that there's no commentary or parody of the original work that means the port effectively serves the same purpose as the original, and therefor a very blatant example of infringement. Granted, still a neat little project, but if I were a lawyer I would not be taking this case unless I was particularly suicidal about my career.

Except they’re not actually distributing assets, it’s other randos who are passing around a compiled version with the ROM included, which is where the illegality comes from. It’s the same principle as GZDoom requiring the DOOM/DOOM2.WAD file to run. As long as the code itself is original they should be legally within their rights.

I know dumbass but I am interested in being able to get future versions without running here for help or possibly catching a Trojan. Also learning things is good ya know. Certainly not too hyped about this version with 30fps lock and no real fullscreen.

Really wanna make another point of it: the inner development circle and fans are trying very hard to keep this from being accessible because of how fast this can and will escalate. I've done all I can to provide an accessible version and a list of controls, since they used a really fucking strange way to bind the controls.

By "escalate" I'm assuming you're suggesting that either this could kick-start a craze of people porting Nintendo games to PC, or an abrupt DMCA by Nintendo. Probably the DMCA, if Nintendo hears enough about it, they'll probably try to strike it down. This the second time I'm hearing about a pc port of a Nintendo game. Brings this to mind:



URDE is a fanmade open source port of the legendary 2002 Metroid Prime to PC. It's been compared to GZDoom in that you'll need a copy of the game itself to get it working. Even though it's still a work in progress it's looking good so far and it'll probably be finished. It might end up like AM2R, getting fully released then DMCA'd, because Nintendo are a bunch of dicks.

One last thing I'll say about that though.

Even if it ends up DMCA'd by the assholes at Nintendo, it won't matter after these ports are finished.

They tried killing AM2R, and failed miserably. Not only can you still get the game with a simple internet search, it's still being updated on the AM2R subreddit. A new group of developers found out the source code and picked up the game's development after the originals left.

They tried killing Pokemon Uranium, and also failed miserably. Similar to AM2R, you can get the game online with an internet search, and it's been updated numerous times by a new development team.

Wouldn't be surprised if those selfish fucks try to kill these ports after they're announced done. However, the minute it becomes popular and accessible there will be no stopping them from being picked up by someone else. No matter how much legal bitching they do.

Same thing will probably happen with the M64 port. I'm not sure if I'll play this because M64 was never something I got into, it just looks kinda meh. I'll probably download it for the sake collecting shit people want gone off the internet.

The biggest thing that has me hype bonered is the source code having open access like this means you could theoretically update it with modern graphical assets from say Mario Odyssey, a good camera and mod support. And there you have a fuckin awesome mario game that can theoretically be ported to any device. Nintendo should give up playing big boi with their ip's. They fail to recognize up and coming developers wanna play around with their ip's because they inspired them to make games and making your own characters and assets is a fuckin bitch. All these fan projects usually attract niche audiences anyways so the fucks the point in strongarming. Not like the normie kids who play this shit are gonna follow all these weird steps to play this shit when kiwi r.etards in this thread can't even do that
