Has it been confirmed DD's mom is in the condo? Something about this plan doesn't make sense to me as a Canadian law fag.
I've done child protection files, adult protection files, and Crown work in my time. Generally, when a person is old and infirm enough to require inpatient care at a private or public senior's home they are evaluated by a social worker and medical team.
Healthcare is provincial government jurisdiction in Canada, as is social assistance, and social work so each province is a little different in their methods but they are similar.
Even if you want to remain I your home and you have the money to pay for in-home care you have to be evaluated by the docs and the social worker. Because unless you can afford to do up your house like a hospital setting most elderly people cannot remain at home even if they are money bags because it violates legislation (think occupational health and safety for the care givers) to be in the home.
Care stages are listed as 1, 2, 3, and 4 (or some variation thereof). Once you hit level 3 or 4 you wind up in a public elderly home because those buildings are half hospitals/clinical settings and we don't allow private hospitals in Canada (we do have some private service doctors, especially those that do imaging and cancer care but they are rare and costly).
When we saw DD's mom at her facility it appeared she was bed bound and Nader even spoon fed her. If she requires diaper changes and can't say wash herself, feed herself, etc she is likely beyond stage 2 care. I would assume she has a social worker. Quebec does have different civil law from the rest of Canada, they are not a common law jurisdiction besides for criminal matters...but Quebec also tends to be more socialist and state interventionist (because French) than English Canada.
I can't imagine the social workers and doctors involved in DD's mother's care would be cool with her leaving say a stage 1 or 2 facility (which can be private and for fee) and being cared for by Nader and DD when age doesn't reverse. If she is unable to feed herself now she is already or about to be stage 3.
In instances where the old person or their family can't pay for care or rhe copay for the public care the state covers it once they are stage 3. But, you will be put where there is a bed available which could be anywhere in your province. And while putting distance between the elderly and their loved ones sucks...the social worker isn't gonna let you take a stage 3 elder into the home unless you can provide them stage 3 care in-home which is super costly.
I may be wrong. I've only been the government lawyer asking the court to order the elderly person into stage 3 care against their or the family's wishes because the individual and family are not capable of caring got themselves/them. And I've never practiced in Quebec. So, if any QC lawfags or social workers know the deal please correct me.
To me, this sounds like Nader and DD trying to create a situation to mitigate Nader's possible sentencing if he goes to trial (you can plead out any time before and during trial) or give him something to use for a gentler sentence if he pleads out.
Basically ppl will have kids, get pregnant, take on a dependent of some sort to try and argue at sentencing they should serve their time in the community or no time at all (suspended or commuted sentence) because they are primary carer for a dependent.
I don't remember of the top of my head...but I don't think someone guilty of SA (especially with a past conviction for violence against women-your past crimes don't count during trial and can't be brought up but they do count for sentencing once you are found or plead guilty and they count against you not for you) is able to do community time. It might have a mandatory min jail time.
Either way if this is Nader and his lawyers Crack head plan to avoid jail it is pretty crackhead. I don't think health and welfare workers will allow it and even if DD could afford to pay for in home stage 3 care Nader is not a trained personal care attendant or nurse. Nor is he a blood relation. DD's mom is not his legal dependent. The relationship is thin at best.
Sorry to be so long winded...it's the nature of my trade, but until the mom is shown in the condo I have my serious doubts this is anything more than a desperate plan by a desperate accused and his shite defense lawyer.
Remember, just like doctors who got Ds in med school, there are bottom of the barrel law students out there who became lawyers. And not to diss my sole practitioner colleagues too much, but most of them wind up in sole practice which I believe his lawyer is because they don't have the stuff to work for a firm, gov, or in-house.
