Well their have been cases of Child Abuse investigation units members being charged as pedophiles. I mean, I guess if you were pedo and wanted to look at child abuse images all day, what would be a better job?

However bad an idea this is, it isn't entrapment. Entrapment is a very specific term for getting people to commit crimes they otherwise would not have, and then busting them for it. The definitive entrapment case is John DeLorean, the dude who invented that car in Back to the Future. He would never have even considered dealing coke and a vast, elaborate scheme by the FBI was invented to coerce him into doing that, solely so he could be arrested for it, for no reason that makes sense to anyone.

This was such obvious bullshit that he won the case.

That's what entrapment is. It's when the LEA literally goes out and creates the crime.

So if they got caught it's not really entrapment. It's something else, called "enticement." That's legal.

These cases aren't being thrown out for entrapment, because the actual behavior here isn't entrapment. It's enticement, which is actually legal for LEAs to do.

They're being thrown out because these idiots won't disclose how they got their evidence. We have weird rules in the USA that people only get convicted if there's evidence against them. And "lol fuck you" is not an appropriate response to a judge's request that these feebs actually explain why their evidence is actually evidence.

Actually didn't it say in one of the articles the FBI helped improve the functioning of the site once they took over? like... wow they really care about their customers.
 
Entrapment is going off to someone saying "hey want some drugs" then arresting them when they give you money.

Seizing a members only child porn website on the dark web and using it to find members is not entrapment in any way whatsoever.

It isn't also just the police conduct by itself that makes a dismissal on grounds of entrapment possible. The defendant also has to have had no prior proclivities toward such crimes.

Specifically, from the DoJ:

Entrapment is a complete defense to a criminal charge, on the theory that "Government agents may not originate a criminal design, implant in an innocent person's mind the disposition to commit a criminal act, and then induce commission of the crime so that the Government may prosecute." Jacobson v. United States, 503 U.S. 540, 548 (1992). A valid entrapment defense has two related elements: (1) government inducement of the crime, and (2) the defendant's lack of predisposition to engage in the criminal conduct. Mathews v. United States, 485 U.S. 58, 63 (1988). Of the two elements, predisposition is by far the more important.

This is a case where even if government behavior would otherwise count as "entrapment" of some sort (and it fucking does not), the predisposition of the defendants to commit exactly this sort of crime would vastly outweigh it.
