Common sense says that going to war with Sargon would be a bad idea in Ralphs position. I'm pretty sure Sargon has a larger audience and doesn't still has his man servant Vee? Without daddy Jim Ralph doesn't have a chance. And I'm pretty sure the last Sargon saga left a bad taste in Ralphs mouth and he wouldn't want that again. No. There is no recourse to DMCA abuse. The law is written so massive IP holders can do whatever they want with impunity.

Yes. There's even a statute specifically for it, part of the DMCA itself. 17 U.S.C. § 512(f). It has been used against corrupt voting machine company Diebold in the Northern District of California exactly once, when they used DMCA to strike content that exposed their defective products.

Good luck pursuing such a case without a significant war chest though. If you were going to pursue such a case someone like Randazza would be the guy but the questionable likelihood of collecting and the distance of such an outcome would almost certainly mean you'd be paying up front out of pocket.

The actual damages would likely be small, so the majority of the profits would be going to counsel anyway, but with fee-shifting that would easily be in the mid-six figures or so. So a very expensive gamble unless you could find counsel willing to front it, or an organization like the EFF willing to act pro bono.

And Ralph, of course, is a judgment proof loser who will be dead or in prison long before you could ever collect and even if you got to that point he will be a penniless loser with creditors far ahead of you in the queue, such as the felony nonsupport his baby mamas will likely be pursuing when he accrues more unpaid child support.
