The plebbitor is generally right, though. Juries are very rarely sympathetic to someone who gets their ass kicked after provoking the attacker. Even though it isn't technically a legal defense ("provocation" as a full legal defense generally requires more than mere words), a jury will usually find an excuse to let someone off easy unless the beating administered is way out of proportion to the insult.

I mean, they've already been trying to push the "you don't have to pass to be trans" thing for years now (even if it's mostly to make themselves feel better about the fact that none of them pass...), so it's not exactly a far leap of logic to make from there..
