[Resolved] Domain Registrar & Epik's Seizure

Epik LLC has made two claims on X :
1) They were forced to put a clientHold on kiwifarms.net by Law Enforcement, which we evaded by moving the domain out of the country.
2) That the Kiwi Farms "hosts child porn".

These are both false, and these are both instances of actionable per se defamation. The damage of these claims is inherent in the claim and they are already being parroted by adversaries for the purposes of trying to further erode our ability to find stability and sure footing on the Internet.

Epik is a Wyoming LLC, X is a California LLC, and Kiwi Farms is a West Virginia LLC. To pursue this, I would have to find a lawyer in one of these jurisdictions. I don't know any.

Taking a case to trial is at least $75,000. However, they would be able to pay because they are a big company, and this would be an amazing step for being able to show providers: Yes, we are legal, and yes, we are taking steps to remedy actionable defamation to the contrary.

I've put up a poll. I am already dealing with litigation and saving money for another case. Would the community itself actually want to finance litigation?


Edit: I will find a way to get fiat working so you don't need crypto, but special crypto wallets can also be set up.

Apologies for the probably terrible formatting. Included the videos of him singing 'I Want It That Way' to compare the voice. Given there is almost 9 months difference between the two. Aside from audio quality and overall enthusiasm, for lack of a better term, it's the same person. Also @Miaoooww's posts almost entirely comprise of retweeting @Miaouwo's tweets until August 23, 2023 when it stopped. Same time as when it stopped liking anything. Figured I'd chip in with the connection since someone on page 73 of this thread made a comment about a possible connection. *edit* To clarify, indeed it is the same uwu.tv ceo.

The problem is that this is an official account that represents Epik.com (Epik, LLC) as a company and not just some shitposting account with 2 followers.

This is why you don't hire some snarky retard to run your company's official Twitter. They can in the space of two hours open you up to a raft of lawsuits just by being a massive faggot online.
 
I don't know if this will be a slam dunk. I'd honestly rather see no-dong and associates get hit with tortious interference and related actions. If this is the low-hanging fruit, though, I'm willing to toss a couple of silvers at it (though not as much as some of you rich denizens) and figure that it's unlikely that there's a lawyer out there who wants to take a case from KF unless he thinks he can win.

...or he's crazy. That is also possible.

Same deal for me. I'm all for it but I'm also a faggot, so would need a decent way to send the cash and not automatically get flagged as a transphobic monster that must be destroyed. Not going to vote on the poll unless I can properly contribute to the war effort.
 
I had to double check and make sure that it wasn't some sort of a parody account on Twitter, because holy fucking shit, how unprofessional can you get? Take these niggas to court, Josh. 75k is a lot of money, but further allowing rumours like this to go around will cost you even more money and support further down the line IMO. You already have a hard enough time finding people willing to provide services to host the site, and shit like this really doesn't help the situation, but suing Epik and winning might actually turn things in your favour going forward. It makes an example that you won't be fucked with, and you're willing to defend your business from people who try to fuck with you even if it does cost you tens of thousands of dollars in the process. It'll make a lot of providers scared of illegally fucking with your site and reputation going forward.

Regarding funding things, I'd love to chip in for this, but money is kinda tight at the moment due to some personal expenses I'm going to have IRL for the next few months. Depending when the donation drive starts, I may or may not be able to donate depending where I am financially at the time.

I'm sure Josh would love to sue Epik with government money, just don't bother sending him any government cheese.

So, I'm confused. It sounds to me like they may be claiming that state authorities intervened in Epik's attempt to steal the KF domain and forced Epik to transfer the domain to another registrar, not that the authorities were involved in the decision to place a clientHold on KF. Trying to figure that line out.

I have only two things to say:

It is unwise to rush to law. I would only recommend proceeding with any litigation if it can be shown with certainty that the operator of the account that writes like a chimpanzee on methamphetamine is both the official spokesman for Epik, and was writing about US jurisdiction and not any other in his tweet. There are those who post lolicon on this site. This material is legal in the United States, but is considered child pornography in some other jurisdictions, a fact which Epik will certainly use to their advantage should they be pressed in court.

Unfortunately I cannot donate to your effort at the moment. I have very limited funds as I am also engaged in litigation. Should my situation change, I'll certainly send you some money.

That said, I don't see the point in trying to sue. They'll pay a fortune for lawyers and will play the 'well we were told you hosted CP so we had to act in good faith and drop you no matter what so you can't sue us' card on that statement and who knows what they got, didn't get or believed they were going to get in the future as far as an order from law enforcement. They could claim they were expecting to receive such an order and acted pre-emptively

Epik has better lawyers than you can afford, far more money to pay for a defense and has a pretty reasonable defense for their actions. This is a pick your battles situation and this isn't one you have any realistic chance of winning

I wouldn't count on that, given the negative impact such a thing would have on their business. It would raise too many red flags with clients and potential clients. If anything they're better off throwing money at fighting it and out spending you to keep their reputation in tact. and if they beat you in court its then a matter of public record that you lost against them on a claim about no CP being on the site and/or that there wasn't an order to do what they did. The troons and everyone else out to get the site would jump on that and use it against you every time you said nothing illegal goes on here. Might even use it to get you blacklisted at every ISP you go near. Plus they have a reason to see it through given how against the site they are in general
