That thread was so full of faggotry I could never forget it. Part of me thinks the leet hacker did a gayop and sent a complaint to Epik and that's why they're saying this.
Is that why he took credit for it getting seized or whatever? Posting his own nudes and then reporting them as CP? What the fuck? As if that whole arguing with his sock debacle wasn't bizarre enough.
 
Not to imply that this is directly relevant to the potential defamation lawsuit, but couldn't the representative be prosecuted for posting what they genuinely, seriously believe to be child porn, even if it obviously isn't? Not sure if this is the same as To Catch a Predator where it was enough that the predators thought their victim was underage, but actually wasn't.
 
Sorry for the stupid question but how do we know when these NSFW photos were taken?
One of them has a date stamp, and he looks extremely similar in the rest. One also could assume in good faith that including the date stamp was a amateur mistake, and was the first photo.

People fall upward all the time and for all kinds of reasons; it doesn't matter whether you're talking about the military, the government, or the corporate world. Whether it is the communications officer or a zoomer intern running the account, there is no guarantee they're not retarded. Supervisory hierarchies and designated job responsibilities exist for a reason. A lot of things go to hell when there is no oversight.

"Someone" who registered a KF account went to that thread (brilliantly using Incognito mode) around December 10th and used their phone to take screenshots either:
A. Allegedly alleging that the pictures in question constituted CP,
OR
B. Reported it as "doxxxxxxing" and Epik upon their review made the spontaneous determination that the photos constituted CP.

And, instead of contacting the site administrator and law enforcement, decided to simply seize the domain.

Has anyone seen Elaine Miller's phone UI lately, by the way...?

Also, wasn't it determined that the info was posted by the guy himself or something?

I admit it's entirely possible I misinterpreted all of what you posted, or maybe you're completely wrong, but what I gather is:
  1. Someone registered an account to plant porn.
  2. Used it to constitute doxing.
  3. Used it to constitute "CP" (which it is not).
  4. Used it to take down .net.
Child porn implies children are involved in some way. A 20+ year old is not a child, so porn of him definitely isn't CP.

If I'm right in how I interpreted events, this is the internet equivalent of a false flag.

If possible I would call a lawyer and even seek criminal.

It's going to be tuff to prove defamation and remember not to long ago in the Mushmouth case the court ruled against Null for what is basically "we don't condone such a site as Kiwi Farms no matter what the law may say".

Just because the 'tards at Epik allowed some intern to post on their Twiiter doesn't mean that a court will see that as an actionable case of defamation. Everyone always tends to forget the US justice system is pretty much a joke at this point, all it takes is some Liberal judge to go "umm no, Kiwi Farms bad" and Null owes 75K in court fee's ontop of what ever he's spent on lawyers no matter what the facts say.

If I were Josh I would think very carefully if this is the right way to deal with Epik. Not because he's in the wrong but because the system is so corrupt and broken that their is a very high chance of some activist judge smacking the suit down just because they read that Kiwi Farms is a far right hate site that wants total tranny death and so Josh will have an uphill battle from the start. Not to mention the usual suspects will be all to happy to do whatever they can to spread lies to harm the site.

If you do go ahead Josh, be prepare for a long fight. Epik will try to bankrupt you rather then lose the case as they probably have council on retainer like most big companies so they can afford to keep dragging out the case year after year. I'd say 75K is on the low side. I'd have double that or more before I would feel comfortable going ahead.

I would love to see some big ISP held responsible for their actions but that's not the world we live in today.
