There is no issue with consent here. Reuben clearly was aware that Jace was recording the conversation. It's strongly implied that Reuben may have even asked Jace to record it. Reuben didn't start bitching about consent law until after Jace mentioned that he was going to post it. Consent law is about consenting to being recorded, not about consenting to publicity.
That is exactly one of the questions that has to be handled in reviewing the legalities.

Besides I'm talking about a fact-agnostic discussion rather than something highly dependent on the circumstances. As I've said before, even if Jace was totally in the wrong as far as the law is concerned, the odds of him actually getting prosecuted are miniscule, particularly given what we both acknowledge: both parties consented to a recording.

"I've reviewed the law" is never a sufficient explanation for how you reached a legal conclusion. That's what I'm talking about writing out.

And please, please do not just tell me that the statute says "X" and in your opinion what happened was "Y". A critical reading of the relevant statute is where good legal analysis begins. It continues by looking at cases where that statute has been construed.

I think that's the point I was trying to make if Jace didn't do what he did this guy would have flown under our radar.
My first reaction to seeing his blog was: "Oh another 'news site' I've never ever heard about." I took it at face value, boy was I pleasantly surprised.

My point is simple: things you might think is worthless might not be so in the future.
Things that seem pertinent now will be the "all your base belongs to us" of today.
