The UK government may seek to block Scottish gender reforms making it easier for people to change gender. It comes after the Scottish Parliament voted to lower the age when people can apply to change their legal gender to 16, and remove the need for a medical diagnosis of gender dysphoria. But this has prompted a clash with the UK government who have concerns over safety for women and children. Nicola Sturgeon's Scottish government says it will fight attempts to stop it. On Thursday, members of the Scottish Parliament (MSPs) voted by 86 votes to 39 to approve the controversial self-identification system, which makes it easier for people to obtain a gender recognition certification (GRC).
The UK government could prevent the legislation becoming law by blocking Royal Assent - when the Bill gets formal agreement by the King and becomes an Act of the Scottish Parliament. It has also not ruled out mounting a legal challenge. UK Minister for Women and Equalities Kemi Badenoch said the Scottish government has not addressed the implications of the bill on the lives of women and girls. She said in a statement: "The UK government is now looking at provisions that can prompt reconsideration and allow MSPs to address these issues." Scottish Secretary Alister Jack warned: "We will look closely at that, and also the ramifications for the 2010 Equality Act and other UK-wide legislation, in the coming weeks - up to and including a Section 35 order stopping the Bill going for Royal Assent if necessary." Under UK law, it can apply to have Scottish laws struck down by arguing they would conflict with UK-wide equalities legislation. This power has not been used before.
But a spokesman for the Scottish government warned that any attempt by the UK "to undermine the democratic will of the Scottish Parliament will be vigorously contested".
Scotland's Social Justice Secretary Shona Robison, responding to Mr Jack, said: "It would be very disappointing if the UK government didn't respect Scottish democracy and the decision of the Scottish Parliament.
"This area of policy is entirely within devolved competence."
Previously, Ms Sturgeon said she would "never apologise for trying to spread equality, not reduce it, in our country".
The Gender Recognition Reform (Scotland) Bill's opponents, including nine SNP MSPs who voted against it, have fears over its potential impact on women and girls, in particular single-sex spaces, like toilets.
The Scottish government insists little will change and exceptions barring trans people from single-sex space in some circumstances in the Equality Act will stand.
People in Scotland have been able to change their legal gender from male to female or female to male since 2005. The Scottish government believes the existing process can be intrusive and distressing and put people off applying for a Gender Recognition Certificate. The new rules, which are expected to come into force some time next year, will mean applicants will now only need to have lived in their acquired gender for three months - or six months if they are aged 16 and 17 - rather than two years. There will be also be a three-month "reflection period" during which they can change their minds and it will be a criminal offence to make a false declaration or false application for a GRC, with anyone who does so potentially facing up to two years in prison. It will be possible to de-transition by going through the process again. Nine other European countries have already adopted self-declaration systems for legal gender recognition, including the Irish Republic, Denmark, Norway, Portugal and Switzerland. Also on Thursday, Spain passed a bill bringing it a step closer to allowing people to change their officially registered gender by filling in a form.

Westminster HAS to block it. It can’t be left it causes too much clash with UK law.
The only doubt is how much Westminster will oppose it bleeding to them. On the one hand Westminster has been affected by the Long March through the institutions and is woke - and Westminster rules the country, who sits in the commons is largely ceremonial for them (the lords are more of a bulwark.) on the other hand there’s a big backlash against all the tranny stuff in England and Westminster know that.

Sir Keir Starmer would change the law to allow transgender people to self-identify their gender if Labour is elected, it has been revealed.

The Labour Party's divisions over Scotland's controversial new gender law were laid bare yesterday, as MPs were said to be split over whether the party should back First Minister Nicola Sturgeon's new rules, supported by Scottish Labour, on transgender recognition.

Mr Starmer has now said he would 'update' the gender recognition act, despite concerns the move could affect women's rights, The Telegraph reported.

The policy announcement follows Holyrood's new rules on gender policy, which allow 16 year-olds and over to self-declare their gender without a medical diagnosis.

The Gender Recognition Reform Bill (Scotland) also lowers the minimum age to change gender from 18 to 16, and slashes the time to get a gender recognition certificate (GRC) from two years to three months.

But the Bill has provoked fears abusive males could take advantage of the system.

A Government source accused Labour of trying to play both sides, saying: 'They can either acknowledge and defend the rights and safety of women and girls, or they can stand with the SNP in unpicking those rights, and the potential consequences of that decision.'

A Labour MP said Sir Keir appeared to be following views of 'Labour's young, mostly London-based activist staff'.

The MP asked: 'What are the opinions of the leader or the shadow women and equalities secretary?'

Another Labour MP said 'a lot of women in the parliamentary party are against it' with 'as many for as against... it could be 50/50'.

And another MP said: 'On so many levels this bill is flawed but the intended and unintended consequences this legislation will have on everyone including our trans community is going to be a nightmare to resolve across the UK.'

But Labour's Baroness Kennedy, a human rights barrister, said Sir Keir should 'look at legislation that is appropriate to England and Wales'.

'The idea that the Scottish parliament should be overridden by Westminster because the Conservative Party don't like this would really be very disruptive to the unity of the UK, and I think that would be absolute folly,' she added.

Ministers are anxious about the impact of the gender bill, which is a devolved matter, on the equalities law, which covers all of Britain.

The Government can challenge devolved legislation if it feels it impacts on national security or reserved matters.

Any action to block it would be unprecedented – and likely be subject to judicial review.

Women's rights campaigner JK Rowling condemned the legislation, sharing an article arguing Labour would pay for supporting the SNP's 'trans crusade'. PM Rishi Sunak said it was 'completely reasonable' to consider blocking Scotland's gender legislation.
 
Shit like this is so nefarious and helps nobody. It serves only to expand the market for 'gender-affirming' interventions, completely ignoring questions of whether they're medically relevant in the first place.

Save for edge cases like precocious puberty where some of these drugs may be needed (and a diagnosis required), I obviously don't think they are ever medically relevant, but at least with diagnosis requirements in place it forces the patient to go through some sort of intake process to evaluate for co-morbid mental illnesses.
Heck, needing a diagnosis was the very thing the trans people were using to say it’s ok. Removing it proves that tgey don’t care about the trans and it’s just a child fucking fetish

It truly is remarkable how whenever the Tories fuck up, Labour can somehow make themselves look even worse.
In fairness to them the parts of Labour pushing for this feel justifiably confident right now. A large chunk of their members, MPs and voters are indifferent to this change or actively opposed, it's just not big enough of a known issue to really drive in a wedge for those people. The fanatics about it however will not accept anything but full throated support. As such keeping those voters is worth annoying a small number of others who, more likely than not, will still not vote Tory.
 
The people generally aren't, but they reflexively vote for the SNP out of a combination of resentment against the English, a vague desire to be independent, and because the SNP aren't tories or labour. The way the electoral system in Scotland is set up also disproportionately favours the SNP and gives it a built-in majority in the scottish parliament.

The SNP itself was formed in the mid-30s, from a merger of a nationalist party (the Scottish Party) and the "National Party of Scotland" - which is one of those cute, euphemistic names used by marxists, in an attempt to appeal to nationalists without actually being nationalists. It's been infested with the same sort of double-thinking, academic twats for its entire history, but because it's got "nationalist" in its name, and because it campaigns for independence, the Scots vote for it.
The PR system at Holyrood was set up by UK Labour (Scottish Branch), specifically to stop the Nationalists winning a majority. Last election Mrs "Both votes SNP" wasted over 1M votes to win 2 SNP seats on the list.
The only way the system disproportionally favours the SNP is because they get more votes.
I wonder how many actual Scottish people support this. Rate me optimistic, but I'm hoping that this is a typical case of a small loud few getting their own way while the majority disagree. And so the SNP finally get a dose of reality come election time.

Sturgeon was compromised around the time she sat down for a cuppa with Teresa May and was told "Now is not the time". She even went so far as banning independence discussion at the last party conference.

We tell 16 year olds not to get tattoos because they may regret it. But changing your gender at 16 and putting yourself on the road to irreversible surgery with serious complications is far worse than getting a stupid cartoon character inked on your arm. Yet transitioning is A-OK.
