Unusual submission again. Translating an announcement video [A] by Shlomo Finkelstein's podcast co-host Kasper, published on March 1 2025
The right-wing youtuber Shlomo Finkelstein has now been incarcerated for over half a year. He is being accused of incitement of the masses in, I think, 6 cases. The case with the longest individual sentence, one year, regards playing back a song by a US comedian. The song is titled What Does The Black Say. The song is still accessible on YouTube, including from Germany without any issues, and now has over 964,000 views.
To cut it short, he has been pronounced guilty in absence. In response to that, the public defender, of whom Shlomo didn't know anything, seems to have filed a complaint, or appealed the decision, as it should be called. Shlomo didn't know anything about that either. And, overall, in the appeal case, this guilty verdict has been confirmed, the sentence has been confirmed, and Shlomo has been sentenced to probation. In absence. On this probation sentence were conditions, namely the following:
A sentence - I want to make this as clear as possible again - which he has received as someone without a prior criminal record. And it is still about speech crimes. The reply by the prosecution back then: No, he's going to prison now, because he paid the 600 euros too late and did not update his registered address.
While serving a prison term, there are ways to reduce the prison sentence. There is the so-called half-stint and the so-called two-thirds-stint. After roughly 5 months of his prison term, there was a knock on Shlomo's cell door, he opened, and there was a man from the prison who asked him to file a request form for half-stint release - which looks to be very unusual, normally the convict is supposed to act proactively and not get asked. But, well, Shlomo filled out this form, and roughly 4 weeks later, the Verfassungsschutz [Office for the Protection of the Constitution, aka German FBI] is in the prison and asks for a talk.
What has meanwhile become public is that they want to bill Shlomo, among other things, the wiretapping of 5 of his friends and family members - the German state wants to have almost 11,000 euros for that.
A good moment to remind you that, currently, there are almost 146,000 open arrest warrants in Germany. Among them are 1473 open arrest warrants for so-called crimes against life, that is murder, manslaughter, and attempted murder, attempted manslaughter. These persons have not been apprehended yet. But if it is about locking up someone who violated probation terms - which, in this case, means paying 600 euros too late and not having updated his registered address - for someone like that we put 5 people under surveillance.
For me as a layman, that sounds unusual. The fact that someone who is considered not dangerous gets arrested in public by a 15-man police unit also sounds unusual to me. The fact that the correctional facility approaches you unsolicited to ask you if you want to fill out this form for an earlier release also sounds unusual to me. The fact that a one year sentence has been demanded for playing back a song also sounds unusual to me.
This Sunday, around 6:30 PM, Shlomo will address the public with a pre-recorded video. The video will be published on the Twitter account of Naomi Seibt, link in the video description, and in the weekly podcast Honigwabe, the entire thing will be addressed live starting at 6 PM, including further info that we will have, and including a discussion.
